Can a Landlord come in and out of your house without warning?
I live in Texas and I have a problem with my landlord coming in my property without any notification. It is usually during the day,but I feel as if it is an invasion of my privacy. He rings the doorbell first and if I don't answer right away,he lets himself in with his key. On one occasion, I was in the shower and when I came out I found him in my home and his reason was he had tried calling me and I wasn't answering my phone (I was home sick and didn't answer my phone for anyone) When I asked him not to do this, he says it is his property and he can come and go as he pleases. Any suggestions or advice?

Ok, so what should I do? call the police or what? It is becoming so irritating and he says as long as I answer my phone then he wont do that but I dont think he should be able to dictate when I answer my phone or when he can access my property... This normally happens the first of the month when rent is due...I have until the 5th according to my lease but come the 2nd here he is popping in my house. I don't know about Texas, but in MN, a landlord has to have your consent, unless it is some type of emergency such as flooding or gas leak. The county offices of your area should have a packet on rights and responsibilities of tenants and landlords, or your county may also have it online. Just type in a search for the name of your county and check it out, or try Texas renter's rights.

This is an issue on which the law is quite clear. Unless it is an emergency a landlord must give notice, usually 24 hours, before entering a rented dwelling. What he is doing is a clear violation of landlord/tenant laws.

However, that doesn't necessarily mean he can be charged with a crime. Landlord/tenant laws are civil, not criminal, so your recourse is to sue him for damages (money). You could call the police and say he is trespassing and perhaps the police would warn him but, most likely, they would say it's a civil matter and refuse to get involved. It's worth a phone call to the police, however. They are, after all, peace officers. The fact that he was there when you were getting out of the shower might give you enough of a hook to get the police' attention.

As far as civil action is concerned, you should make it plainly clear that his behavior is offensive and will not be tolerated. If he continues, send him notice in writing that you will sue for damages if he persists. Start keeping a handwritten diary of every interaction you have with him too.

This is illegal and an invasion of your privacy with or without a lease (which I hope you have). He can be brought up on criminal charges (e.g. stalking) for catching you in the shower.

If he does not abide by your wishes, you should consider moving and reporting him to the police as well.

he absolutely can not, and hez renting it 2 u so actually it is your property and he cant do that, but, some apartments have 2 locks and if u lock one u cnt get in with a key..lock it like that..i guess...god help u.lol....

i'm pretty sure if you ask they should respect your wishes. but i don't know the law.

i know that if they come by surprise & you have illegal stuff going on, it's inadmissable as anything.

HE is breaking the law. He has to give you 24 hrs notice.

You should be able to find the statute that states your right to 24 hrs notice. Send him a copy with a letter stating that if he continues to break the law, that you will have legal grounds to break your lease and will give him 30 days notice the next time he comes in unannounced.

It is also illegal for him to harass you for the rent before it is due.

It would be in your best interests to get a real estate lawyer to help you legaly get out of your lease.

I think "9 daughters" is pretty close, but trespassing is a criminal matter in addition to civil. The landlord is in YOUR PREMISES without permission. During a rent/lease period, the tenant has full possession of the premises although the landlord continues to OWN them. Trespass is the crime of being upon the premises of another without license or permission, and you have not given license or permission for the landlord to be on your portion of the premises (i.e., inside), except under emergency terms and whatever is agreed in the lease.

In Texas you may even be able to shoot a trespasser in your house, so you might point out to the landlord that you don't want to have to find out whether or not this is the law, so he should stay out.

In Maryland you can sue for refund of rent for the entire month in which the landlord enters your rented apartment without permission or good reason.

They are only allowed to do that for emergency , like a water leak or fire etc .

You could call the police but unless you have a lease , he can evict you for no real reason .

Just change the locks and do Not give him a key ( if you really really want this place )
Or move and always put new locks on any place you move to because previous tenants probably have a bunch of keys too .

Your LL should give 24-hour notice, not just show up and let himself in. The next time he does this, order him to leave immediately. If he will not leave, then call authorities. Its obvious that he is not aware of his boundaries. Tell him that you will mail the rent from here on out. This gives him no reason to just pop in looking for the rent. And just because you dont answer your phone does NOT mean he should enter and does not serve as notice to you of entry. In fact, this guy is in violation of the law and when you know he has entered your home without notice, file a complaint against him. When he enters without notice, ask him to leave immediately and call the police.

If there is a way you can secure the door so that he cannot enter, do it, especially when you know it is a possibility he will be by.

Just because it is his property means nothing. He has the obligation of taking care of it, but he also has the obligation of observing the rules and regulations of LL-tenant law which means at least a 24-hour notice. No excuses.

Rent is DUE on the first. Grace until the 5th. He has the right to come collecting on the first. Put on a chain lock and use it, that way you are not violating the "changing locks" rule...

Well, if it says it on the lease that he can come in your home at anytime, then without question, he can. If the lease does not mention that, then I would seriously and cautiously find another place to live. If you want to take him to court, that is totally up to you.
