Can a Rental Manager tell me that I cannot afford an apartment..without a credit check and application?
I am an african american who is looking for a new apartment in the Silicon Valley in CA. I am a Sr Product Manager who is looking to relocate close to work. I recently went to an apartment complex for a appointment to see a 2 bedroom apartment. When I arrived the apartment complex Manager told me that I probably couldn't afford it. How can he tell me that without a credit check, application and or recent check stub. There wasn't even a discussion about my salary. I felt that he just saw me as a black person and he thought "bad tenant". Help me on this. Am I being discriminated against.

He can if you told him how much you make in a month. If you only make $1500 a month, you cannot afford an apartment that costs $900 or more a month.

As you say, the rental manager had no knowledge of what you could afford. It sounds like code for "I'm not going to consider an application."

yes from what you say i would say you have been discriminated against and i would contact Fair housing office/HUD and find out what they can do to open an investigation. Also i would contact the local landlord/tenant law office and see what you can do about filing a case against them. They should not have said that to you without talking about your salary. I will always tell people they have to make a certain amount and let them tell me what they make a month rather than assume they don't make it. Even people who don't qualify on their own can get a guarantor. I'm sorry that this happened to you.

It certainly sound like it. In the state I live in we never assume an income by someones appearance - but "quiet money" as it is called, usually wears denim and old sturdy shoes. Silicon Valley is kind of know for the "new money" look - you may not look like that "new money" - but it still sounds like discrimination. So how do you want to proceed?

I would be surprised considering that the issue of discrimination is so much on the front page. I know what a Sr. Product Mgr generally makes and I know what apartments generally run in Silicon Valley. You definitely can afford a 2 bedroom easily.

The manger may not even be aware what he was saying. did he show you the unit and around the complex? did he offer you a application? I guess I am imagining that if he took one look at you and said what you wrote and locked his door, then yes that would be discrimination.

If you have the notion you might consider calling him and asking him what he meant by his statement and let him know what he said was offensive to you and could be considered discriminatory. If his reaction is so what, then I think it is clear he was discriminatory. If he is anything other than callous, he may not even have been aware of what he was saying.

Yes, it does sound like discrimination. There is no factual basis for him coming to the conclusion that you can't afford it.

Don't let it get you down. You're not the only one who's been in this situation.

I've been there, yes, a white guy. Had a few days off from work(salary est 68K), was working on my car and on a whim decided to go look at new apartments. There must have been 4 places in a row that commented that the rent might be out of my price range. And we aren't talking expensive places, more like 700-800 a month. I just passed them by and looked elsewhere.

YES you are! You need to contact fair housing or a lawyer for this matter. Although if the manager is acting this way ALREEADY does it really make you want to fight and live there, because he will probably make your living there horrible. But he definitely discriminated you.

There's a fine line there. Did he refuse to show you the apartment or tell you straight out that he would not rent it to you? Those two items are discriminatory.

Also, if he said from looking at you that he didn't think you could afford it and then offered to show you something he thinks you could afford, that is discriminatory also. That is called steering and has been identified as discrimination.

If he still showed you the place and did not refuse to rent it to you or did not try and steer you to another apartment then you will have a tough time proving it legally.

From a standpoint of what I think, it does seem that he is discriminating against you. proving it will be the hard part.
