i read up on that & NO they CANNOT enter w/o yer knowledge, presence, permission. they MUST by law, follow certain rules & if u let them in, then ANYTHING in yer home is fair game. they can have it marked 4 confiscation by simply touching whatever they want taken from u. then the partner, marks the item & sometimes they hold u 2 an agreement 2 either pay a certain amt on yer debt 4 the use of yer own item/s that r marked. if u don't pay then they come in & take it & sell it 4 the amt U owe. however, there's good news. they CANNOT take Tools Of Trade, like anything u use 2 make a living, (cars, & any other work related items that help u make $$$) another good thing; u really have the right 2 NOT open yer door; u don't even hafta answer the door or acknowledge them. this is your right. once u DO, yer @ their mercy, only 2 hope they won't take all but the clothes on yer back & yer tools of trade. if u let them in, u could B sleeping on the floor. NEVER let them in!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!...
finally, if there's a possibility u THINK they MAY break-in, simply put everything in2 an off-premise storage unit; just empty yer home of everything valuable. this'll protect everything u don't want taken. |

If he's a court appointed bailiff then yes.
A regular accredited bailiff cannot break into your property, but they can enter with your permission, or through an open door or window. Once they have entered this way once and identified what property they want they can come back later and break in if necessary.
Moral of the story - NEVER invite a bailiff if, and never leave doors or windows open if you are at risk from a visit. |

Hi, Im afraid the answer is Yes provided he has a Warant, it depends on what sort of balif he is too. Its always best if you think a balif is at your door to go outside your back door locking it behind you.. so that the balif cannot get his foot in your front door, stopping you from closing your door, once he is in he can write an inventory listing all your stuff, then come back again and gain entry, to take your stuff away. But at all times he or she should act with politeness and follow the right proceedure. He cannot put his hands on you as it would be "assault" If I were you I would put all my valuebals into storage! that way he cant take them...lol... |

Now let's see you were given a 3 day notice to quit. You disregarded that notice. Since you disregarded that notice you were then issued a thirty (30) day notice.
You failed to take any action with that notice as you did with the 3 day notice.
It the court bailiffs are who acts as the law enforcement agency to follow up and legally remove possession from those that are served then yes they can.
Since you failed to act on any of the legal notices that you were issued, the property is no longer legally yours.

If you have never let them in your house, then a bailiff cannot enter whether you are in or out.
Get into the habit of asking callers who they are and identifying them before you open your door. Conduct interviews through the letter box. A bailiff cannot break in unless he has gained access previously. Then he can enter even if you are out.
They are crafty f*****s so don't answer the door. The paint on the door will last longer than the skin on their knuckles.
Also, don't be intimidated by letters saying they are from bailiffs and they will remove your goods if you don't pay up. A bailiff has to be appointed by a court, either Magistrates or County. They cannot act without this. Dukes Bailiffs from St Helens use this tactic on their debt collections. Manchester City Council employ them. If these parasites are hassling you, contact the court direct.

Remember, they make their money by frightening people and they have very little regard for the law. So photograph them and their car and call the Police. |
