Question Queen Mentally Special! | Can a landlord LEGALLY evict you from your apartment if they found drugs in your CAR? |
My friend's sister & her boyfriend got evicted from their apt. because their neighbor was peeping through their car & found weed & snitched about it. Now, they're coming to ask to live with me. I don't know whether to say yes or no. I don't want them on the streets, & neither do I want to go to jail for their drug possession. I feel sorry for them. I'm very tender-hearted. It's hard for me to say NO. Additional Details I didn't ask for you to try to chastize & judge me, ENGINEER dude! |

I'm certain there was something in the lease about arrests or drug possession being grounds for eviction.
I'm not trying to be judgmental, but in this litigious society, a landlord can be responsible for not making their tenants safe. And if a tenant is arrested for drug possession, and later there is a problem, the landlord knew about the arrest, let the stoners stay and now there is a problem. The landlord could be successfully sued, and that is why they don't tolerate that sort of behavior.
No law abiding citizen wants to have drugs in their neighborhood, even if they are occasional users. Drugs bring a host of other crimes with them, most of them property crimes. This does not bring a feeling of safety.
Don't feel sorry for those that cannot be clean. You are asking for trouble here, and it will affect your ability to find housing in the future. |

I'm no lawyer, but I would think that most of them can for any reason they want to.Probably hidden in the fine print of the lease agreement somewhere.
I've had lots of roommates
Forget the reasons, if they come to live with you made SURE first day /first hour you all talk about paying rent and behaving themselves. |

I believe it is legal.
I am not sure about them living with you. I KNOW you are tender hearted and hate to say no. It would really all depend upon your lease. Do you need your landlord's permission to have someone move in with you? Most often you do and the landlord can make you either pay more or put down a larger deposit.
I know you live in a small town and you sure don't want to risk your apartment for them. You need to take care of yourself and you have to have a place to live.
Only you can decide. If you want my humble opinion then you should tell them no. Let them think the landlord said no.

"marijuana" has a distinct smell and your neighbor could smell it and probably was not peeking but trying to find the source and knew for some time who was probably smelling it..
with knowledge of "2nd hand smoke" and its effects..the neighbor was looking after their best interests..especially with the tobacco industry looking at huge effects in court hearings of "2nd hand smoke" it is a proven fact via court actions "2nd hand smoke"..
unless the person had a "medical reason" for taking the drugs.. they have no case to fight the eviction.
i am on the west coast and numerous doctors are writing on terminal cases "marijuana"..and signing prescriptions for it..
so unless this is prescribed.......yep i would evict..and you could put your own home in danger as well..

Don't let them move in with you. You won't be able to get rid of them later and at the end you be the bad person. give them an excuse not to move in. Don't feel sorry for people who get them-self in trouble. Just have them look for another apartment. |

They were evicted, correct? If so, it went through the courts, so of course it is legal.
Do you own your own home? If so, it is your call.
If you rent, your landlord should be asked prior to you making any decision. Your landlord has the right to refuse to let them move in.
If you allow them to move in without your landlord's permission, your landlord can evict all of you for unauthorized occupants. |

If their lease says not to have drugs on or about the property.. they surely can be evicted. since it is most state law that a lease says that, I am sure it was that... And if you let them live with you, you will be evicted also. It will hit trust me. it is easy to feel sorry for them but they need to learn and you are giving them another reason to not learn. |

Yes, they can, and SHOULD be evicted for illegal activity on the landlords property.
If there was a druggie in one of my properties I would want to know and I would evict them, I owe that to my neighbors.
I do not want drug addicts around my children and would not dream of harboring them and jeopardizing some other family. |
