Can a landlord ask for more deposit after we have paid it?
I signed a contract from jan 2008 to dec 2008 and paid a deposit of £600. My landlord has now issued a new contract for jan 2009-dec 2009 and has asked for more deposit, it this allowed? He has also stated that when one of the tenants moves out, the deposit is increased again.

He can do this if he is giving you a new agreement, you have few choices, either try to speak to him regarding the deposit, he will have to take it out the tenants deposit scheme, and lodge the new amount costing him money. (I presume he has protected the deposit)? You should have a form telling you where it is lodged.
Or you can threaten to move, which means he has to find new tenants, another financial step.

sounds iffy to me. if you are in the uk, speak to the citizens advice bureau about this.

it is legal for the landlord to increase the rent (with notice) - but to retrospectively ask for more deposit money isn't usual practice. I haven't heard the one about having to increase the deposit as someone has moved out before either!

I don't like the sound of this at all. He has £600 of your depoist already, why does he want more? I would get advice from CAB asap.

I would imagine that if your previous contract expires at the end of 2008, then the landlord is entitled to write a new contract valid after 2008 and revise the terms therein.
Nevertheless it might be worth negotiating with your landlord.
He currently has 600 of your quids, which would be earning him money if he invested it prudently (all right - not much - with the current interest rates, but you get my point). It might be worth investigating the term "Net Present Value" and pointing out that you can't spend that 600 quid, but he can, which essentially turns you into a free credit card for him. Be polite and reasonable, and gently persistent.
Of course, I'm assuming you're a model tenant, but if you sacrifice goats to satan on the living room carpet, he may have a point.
The clause about a tenant moving out seems reasonable, providing it's a tenant for the same property. After all if you have a housemate who also ponied up 600 quid, that implies he needs/ wants/ expects 1200 quid deposit.
Perhaps you could suggest that existing tenants be "grandfathered" under the deposit amounts when they first signed up?
I.e. - He charges new tenants the new rates, but you're an existing customer - has he given you reasonable cause to expect expensive repairs as a result of your tenancy? Probably not, unless you're into the aforementioned satanic rituals...
His request to raise the deposit, essentially means he's charging you negative interest on your own money - you loaned him 600, and now you need to loan him more?
I think that would be a good argument, but you'll need to be very polite to stand a chance of winning.

If you have already paid £600 then surely this will be returned to you pre the signing of a new contract.
As far as i am aware a deposit is fully refundable upon termination of your existing contract should the dwelling be in good reasonable condition.
To me it sounds like your landlord is a crook so tell him to stick it and find a new place to live.

Whenever your current contract, and all of its terms, expires, that transaction is complete. Anything after that is a new transaction, complete with new terms if one party so decides. You have the option to find another apartment.
