well if payed all your rent and did not do damage to the apart ment than im sure she is just bad at what she does and needs money ... so she asks you . IM almost poositive int eh agreement it does not say she can ask you for money at any time even if you do not own her money , It does not work that way .

btflsxy4play
i believe not!!!! don't give it to them! if she demands and threatens to kick you out get a lawyer! mine tried to do that but i refused and didn't ask again!

not if the amount of deposit is written in the agreement. however if the agreement is dated with an expiration date, and its time for a renewal, the new agreement may have new figures in it, like a raise in rent, most people get a the same as the months rent for a deposit.

s01psb
It all relies on the original contract. If they want you to renew your lease and the new deposit is larger, you probably have to pay it. It doesn't sound ethical, but if your lease has run out then it's possible. Every state has a housing board and there are rules (some mandated by federal law) that must be followed. Check with your state government or local housing authority if you live in a large municipal area.

Sagebrush Kid
Probably. But you have to agree to it.

We'll assume that you've signed a 1 year lease, then renewed it for another year. Now, at the beginning of Year 3, he's asking you for more deposit.

Perhaps he's seen you're not taking care of the place, or snuck in a dog, or something has made him uncomfortable. He's within his rights to ask for a change in any of the lease terms, and you're within your rights to refuse- and move.

If your rental agreement has expired and you are on a month to month, then the answer is YES he can ask for more deposit.
Every year that I raise the rent, I also raise the deposit. Why? The deposit is equal to 1 months rent, and the economy changes. 1) You skip out and leave no damages, I still have 1 months rent and 2) It costs more now than things did 2 yrs ago to fix things.
It is perfectly legal and actually smart that when you raise the rents you raise the deposit accordingly.

You would really have to look at your rental agreement. AND to see if you are under rent control. some places like LA have really old real estate and I believe if it was built anytime before 1968 or something like that.. then you get a certain percentage added on to your rent each year. But after two years, it's not a deposit.. it's called a rent payment. HOWEVER, if you are on a short term lease (like 2 years) the landlord can up the rent if he chooses, but not MAKE you pay another deposit) I know in LA, if you are late on your rent, you can't ask more than 50 dollars for late fees.. it's punitive. But whatever you agree to pay on your agreement is what your deposit is (should be written on the agreement) and then anything that the landlord asks in ADDITION to that is considered another type of a fee.. your landlord should be clear on what it is that you are EXACTLY paying for... so NO, don't pay him that money especially after 2 years IF he in fact says it's for a deposit!

I wouldnt think so in the US but here in the UK they can definitely NOT! Why does he want more deposit? are you wrecking the place? are you not paying your rent? if no reasons are stated then seek legal advice

no, of coursed!

If he's asking because he's put up the weekly rent, then I don't think he can ask you for more.
The deposit is to cover possible damages and (in Australia) can only be a maximum of 4 weeks of your rent. Usually the deposit is returned when you leave the premises.

Especially if there's no clause in your contract, then be careful, because if it states that you've paid only (for example) $500 rent deposit, but you've actually paid $700 (after he asked you to pay more) then he might be able to only give $500 of your deposit back if the contract hasn't been updated.
If you can then seek external advidce, or be prepared to talk to your landlord about the situation.

It doesn't seem right to me, but you should check your landlord tenant laws.

Try the website below. It is a landlord site, but landlord/tenant laws are there.

They can ask, you don't have to pay it. Unless something changes in the rental agreement (ie the renter gets a pet that wasn't agreed to when the lease was signed.)

Technically they can do whatever they want, but it doesn't seem right at all that they did that. I'd fight 'em about it. And if you think you have enough to back you up, take it to small claims court. No pricey lawyers.
