Can a landlord be responsible for tenant property damage if he neglects a problem that lead to the damage?
there was water seeping into my closet from the (i guess) pool pump. I notified management of the problem from day one
it has been exactly a week, and the problem is now being rectified.

Although the lease says that the manager is not responsible for damages. Shouldn't they be responsible if they neglect the problem.

Yes, they would be responsible if their problem caused damages to your property.

It may be that the manager is not responsible, but I would think the property owner of the building would be held accountable, and even the response time of the manager to tell the owner or to try and correct the problem as promptly as possible.

We all know that it is cheaper than anything we see on the west coast AND as a landlord apparently you have NO responsibilities!!!!!! NONE, ZERO!!!! OR is that considered a slumlord? HMMM?You have one serious misconception about what renters insurance covers. Come on!!! Grow up! Take some responsibility and read a policy! Frankly I woudn't even call my renters insurance and bother them with someone like you. I have never seen so many posts by someone who wants to get away with so much. NEVER!!!!!!!!Were you never taught the word fair? What do YOU do to medigate the tennants problems? Sure sounds like you would leave this poor guy out in the cold!

Sir, yes, you do have rights!!!! With or without renters insurance! Lease or no lease. You do have rights!

No matter what..she tells people to refer to their renters insurance. She is something alright! And adds a mean tone to it too. Go! check it out for yourself! I bring this up because here at "answers" she asks no questions and only responds to landlord/tennant questions. I am afraid she will be construed as an expert. Again (Kimmamarie) check it yourself - buyer beware

LANDLORD'S DUTY OF REPAIR

Landlords of buildings with three or more apartments must keep
the apartments and the buildings' public areas in "good repair."
Landlords are required to maintain electrical, plumbing,
sanitary, heating, and ventilating systems in good and safe
working order. Landlords must also keep in good working order
appliances they install, such as refrigerators and stoves.
Landlords also have a legal duty to keep every part of a multiple
dwelling clean and free of vermin, dirt, garbage or other
offensive material. Tenants should bring complaints to the
attention of their local housing officials. (Multiple Dwelling
Law Sec. 78; 80; Multiple Residence Law Sec. 174)

That is not tenant damage that is landlord neglect, do not worry about the lease so much because the judge will get them if it comes to court.

I dont know what state you are in, but if in MI, most leases state you are advised to get renters insurance. This covers your belongings.
I have no idea why a pool pump would be near your closet, but such a problem can take time, yes even a week or two. Pumps being ordered to be replaced, getting the plumber to put you on his schedule. And if confined to the closet, then it wasnt a very big leak. Otherwise your whole apt would have been flooded. While it unfortunate, I firmly believe it is not the manager/owner responsibility. Especially since it says so in the lease. That comment alone makes me believe you are suppose to have renters insurance.

Even tho they say in the lease that they are not responsible - they CAN NOT waive their legal responsibilities just becasue they put it in writing. You may have a claim provided all you wrote is correct.
