Can a landlord charge a renter this???/?
I am on a month to month for $1310.00 a month. The place sold to a new owner and now they are charging $1395.00 plus an additional $100 per month admin fee for being month-to-month, as well as, a pet rent fee. Yes, A PET RENT FEE????
I moved in over a year ago and had a year lease. Paid my pet deposit and all is good until the new owner took over and is charging these fees! It seems it is extortion to force me to sign another lease as I cannot move out until another month. This was not on my lease that recently expired. The new owner also is now charging me additionally monthly for the washer/dryer that was already included in monthly rent previously.
So the extras are: Admin fee $100, Pet Rent $55.00, Washer/Dryer $35.00 and all are added on top of the $1395.00 when I was told it was $1310.00.
Is this legal? Can they do this? Can they charge a Pet Rent???? I live in Houston Texas and could use some legal answers! Please help!

Some is OK. Some of that is NOT legal.

The raise in rent is legal, if you were given a 30 day notice that it would raise. The same goes for the pet fee, 30 days notice is required, other then that this is all above board.

HOWEVER, the $100 per month admin fee is NOT legal. The washer/dryer charge is NOT legal either. If it was in your original lease it remains as part of your month to month.

Call the local housing authorities and tell them that you are being subjected to a "constructive eviction", they will help you out, and about the illegal charges.

It does sound mean. I checked the Texas Attorney General website. Their online info was very basic. They did list phone numbers to call for info and/or a more detailed pamphlet.

Of course they can do this. And you're free to move out. It all seems perfectly reasonable. Pets are pretty tough on carpets so the "Pet Rent" is very common.

they can. the contract you made was with a different owner, who now has nothing to do with the property.

they cannot coerce you into signing a new lease, so you can move out if you want. the fact that they are changing the original agreement should mean that you can dip out if you want to. i would.

i dont know about the admin fee, but everything else seems legit, even if it isnt fair...

i would tell him that you will move out if he doesnt change it to what you can agree on.

As far as I know from years of renting experience, if you are on a month to month lease regardless of the fact the the owners change, your rent can be increased to whatever or terminated with 30 days notice at any time. The only way to keep a steady rent amount is to be under a signed lease. Since you previous lease expired and you went into a month to month status, the landlord can raise the rent and add fees however they wish. Watch Judge Judy, this comes up all the time. There may be state or local laws that are different from the norm and you would have to call the city clerk to find out what laws are covered by tenant/landlord rules in your area.

It is normal to pay extra for pets, pets do alot of damage and the owner had to spend his money to fix his house.

Do you have a lease? YOu should really look at the terms, especially if they recently sold. Our property recently sold as well, and we weren't charged any fees at all.

I'm afraid that since you did not have a contract or lease agreement, the new owner can charge what they want. And most definitely they can charge for a pet. If you are still in doubt, you can always contact your city governmental office to verify. But most states run along the same lines in this situation. I could be wrong, because someone told me the other day I was an idiot. But You asked, I gave it my best shot.

In Texas, yes, they can. A lease locks in a rate for a set time specified in the lease. On a month-to-month, you are entitled to a 30-day written notice of the increase. That means if you were notified in the middle of the month, then you have the entire following month before it becomes effective.

You have the choice to accept the increase or move by the time the increase becomes effective. In the absence of a lease, the landlord can provide written notice of at least 30 days that you must move unless you choose to take a new lease.

And yes, they can itemize the charges as they've done.

I have no idea about the Laws in Texas but, this is ridiculous. I have never heard of such fees. I might pay the old rent with the fees or the new rent but, not both. Try looking for something else. I know its hard and moving is such a Bit..
