Can a landlord charge me for a new subfloor in the kitchen when we only ripped the linoleum?
I am having so many issues with my old landlord and we haven't lived there is over a year. She is charging me for the following damages...
-Tear in the linoleum $900 (we agreed to buy new linoleum not put in a whole new subfloor and pay a professional)
-Reglazing of the enamel bathtub because I used the magic eraser on it. $350
- Crack in the laundry tub - $200
- Plumber because the bathroom sink was clogged. $200 (there was draino under the sink when we moved in.

She kept my $500 security deposit and still wanted $1200 out of us.
Once we moved out, rather than mailing me the list of items we were responsible for she showed up at our new house unannounced. I told her I had to read over the paperwork and I would get back to her. Well I didn't get back to her in a timely fashion so she started calling both of our employers and telling them things that is nobody's business. I ended up agreeing to paying the bill because she ended up being a stalker and I couldn't take the harassment.

I have paid her $700 on top of the $500 security deposit and I honestly can't afford anymore. I am about to go into labor any day now and we have a court date in a few weeks. I just want to know where I stand before I go into court. She said that she didn't have to show me receipts because the bill was so high which doesn't make sense.

Any help would be appreciated! thanks

Oh and this house was built in 1957 and not one thing has been done to it as far as upgrades. I feel like she is taking advantage of me because she wants things updated. Another thing... both my fiance and I were on the lease and she is only taking me to court. What's up with that? I've given in once because she is so intimidating but I won't allow myself to do it again.

Tear in linoleum. That is why I do not do lino, I only do tile as you can just replace the part that is damaged. If water got under the lino and damaged the subfloor, thats just more damage you have to pay for. Did you think you going to just buy the new linoleum and leave it sit on the floor or that it would install itself? Someone has to install it. And most landlords use professionals. Pay it!!
Plumber sink for bathroom sink clog. You clogged it, you pay to have it unclogged. And sometimes Drano just doesnt do it. I have drano in my bathroom and kitchen just in case. Pay it!!
Reglazing the tub because you took the finish off it, pay it!
Crack in laundry tub? You didnt elaborate on that one, so I wont comment. So far the amount comes to $1450. Sounds like you moved out before your lease was up, so you are paying a penalty there for leaving early.
You admitted fault here and have already paid all but the remaining $400.00. Is that worth going to court? Court costs and court related expenses can run from $50.00 and up to as high as $1,000.00
Pay the landlord, save your credit, have your baby, and get on with your life. And why are YOU paying all this money. Get the fiancee to pay half of this. He was there too.

She was required by law to give you written, detailed list of charges.
Pull out your lease and READ it carefully.
Organize your information, create concise chronology
LLs are NOT allowed to stalk you, and her showing up at home and calling your employers will NOT look good for her.
Go online and check out your state's LL/Tenant law
Anytime you go in to court, you have 50/50 chance of prevailing. . .being organized, with any proofs, gives you an edge

Obviously, you do need to pay for damages you caused, but your damage deposit does go towards it and she does have to show you the reciepts for the repairs if she is going to bill you for more. I think she overcharged you for everyone of those items. The fact that she doesn't want to show you the reciepts backs that up.
Since you are already going to court, that's actually good. I think the judge will side with you, since you have paid her a lot already. If she doesn't produce the repair bills in court, you may even get some money back. Until the court date, do not communicate with the landlord, and certainly don't give her anymore money.

You need to show up in court with as much Documentation as you have. You need copies of all checks or receipts showing any and all money paid to her. Be honest and most of all calm and courteous to her and the judge during proceedings and let the judge work it out.

If you damaged something, yeah you have to pay for it, but she's being a little ridiculous! You totally have a case against her. Her harassment isn't going to look good for her too.

I wouldn;t even respond to them anymore - plumbers don;t charge $200 to unclog a sink and unless the linoleum was brand new - they have to take into account depreciation, normal wear and tear and shouldn't make you pay for all the brand new material - and sub floor is NOT the tenants responsibility - it takes YEARS of water damage for a subfloor to need replacing - tell her to screw off - don;t even talk to her or give her your new address if possible- you've paid enough - an intelligent landlord charges enough rent up front to cover regular repairs and maintenance

She will prob try to sue you and lose. You can't charge a tenant for upgrades and the flooring you damage has to be prorated for its lifespan. If it is over 20 years old then she really can't charge you for it. Some of the charges definitely look like normal wear and tear on the apt. The laundry tub crack is wear and tear. She also can't charge you for the plumber unless she can prove neglect(like you put paint or dirt down the sink)

You can also bring up that you are both on the lease when you got to court. She has to file against both of you if you are both on the lease or it is an invalid case. I think you and your fiancee should counter sue for most of your deposit.

Charging you for re-glazing a FIFTY year old bathtub is ridiculous. It has no value and you were using a common cleanser as directed.

Calling your employers and hand delivering at your new address is also harassment.

Hold on tight and let them bring you to court. Bring affidavits from your employers that she was telling them about you situation. I think you have a good chance of getting some of your $700 back.

Alway get a lost of damages/conditions of an apartment when you move in an move out.

The condition of the current apt has little bearing on your case. Once again they can only charge for what was done to the old apt and not for upgrades.

sure can. The Professional is probably not wanting to tear up all of the old vinyl. Its faster to just lay 1/4 inch underlayment over the old and lay down the new. But I would think $900 would cover all this. Must be some expensive vinyl.

STOP paying her and seek help from a local law authority or tribunal. To have linoleum means it wasn't a brand spanking new house anyway and you are not made to pay 'wear and tear'. I think you payed emnough already. Do you have a condition report? That would help your case. They are not allowed to stalk you. Please take it to a tribunal, I had a situation similar but was in the right. If you live somewhere for a while of course you will have wear and tear damage from furniture etc. This is ridiculous. Seek a lawyers advice asap you might even get ur money back!

and the "judge" will gie it to them!
Sue them 1st for anything you can think of!
