Can a landlord charge me for curtain cleaning at the end of lease?
My landlord wants to take money for curtain cleaning from my bond. When I moved in they weren;t even clean! Is this legal?

It was likely spelled out in very fine print when you signed the lease agreement. You need to dig out the contract and review what it says. Contracts are often written out by lawyers who use complex legal jargon language that most people don't comprehend.

In California, you only need to leave the apartment in the same condition it was in when you moved in - LESS any normal wear and tear.

The landlord is also required to give you the opportunity to do a pre-move out inspection which must list everything you need to do to get ALL of your deposit back. He would have had to list that the curtains needed cleaning and give you the opportunity to do it before moving out.

If he/she doesn't let you know about your right to a pre-move-out inspection, he can't deduct ANYTHING from your deposit.

This is all in California. You can then ask for your money back and if it's not returned, you can take the landlord to small claims court & win.

if you checked off a moving in report that stated they werent clean when you moved in you may be able to fight it, but otherwise yes you can be charged for cleaning things such as curtains, blinds, windows, carpets, countertops, vinyl, ect. it should be in your lease that you signed when you moved in. just look it up, if it isnt then you can possibly negotiate..but legally you are responsible for move out cleaning.

Much will depend on what your contract says. It's not unknown for such charges to be made - have you concrete proof that the curtains were not clean originally?

I don't know if it's legal, but it sure sounds fishy, I've never been charged for curtain cleaning, and I've lived in many apartments.

I'd think it would fall under "normal wear and tear" but it depends on if they slipped it into your lease.

Your LL sounds like a real jerk to even try to keep your money for that.... don't be hesitant about filing in small claims court to get your deposit back. I have a feeling you would win.

Add:
I'm assuming it's a private landlord, and not some huge complex, because complexes would never have curtains, they would have slatted blinds...

Call and get a few price quotes for cleaning curtains, and see how the cost matches up with what your landlord is claiming for...

It depends on your contract, but usually, yes.
If you could prove to an independent arbitrator that the cleaning of the curtains is not necessary or they were no dirtier than when you moved in, then you may have a case.

check you r lease and your move in check list If they were dirty you should have NOTED it on papaer and keep a copy Sometimes there is a preset cleaning fee which is non refundable-you would have signed it Otherwise you may challenge it ....check with your local landlord tenant association or govt agency that deals with that.but usually most people dont have the time or energy but it wont hurt to try. Do not lose your temper or ruin your renting record .

unfortunately then can because of something that made the curtains smell or was on the curtains. If you smoked it could have left a smell in the curtains and that alone could have made the landlord need to have them cleaned.

it's a standard operating procedure. once you move to a rented house you should clean it first before moving in. even if the owner had clean it already. when you choose to move out you should clean also before moving out. i think your landlord is wrong in taking money or charging you for curtain cleaning. there is no such a law. what can i advise you is to report this to the authority.
