Can a landlord charge per day for not returning the key?

Well he sure can't rent it out until the key is returned. You should have given it back right away seeing as how you weren't using it......or were you?

If it's in the contract he can. If you have the key you also still have access to the apartment and still retain possession. He could change the locks which most would because copies of keys could have been created.

Yes. In NYC, you are still considered in "possession" of the apt. until all keys have been returned.

I myself have a half dozen locks laying around and when a tennant moves out I replace the locks with a recycled one. This way any keys that are not returned are not the keys that are on that current door. Eventually each lock does make it back onto a door but usually not the same one and usually a year or two has passed.


Trouble
Yes. If you retain the key, you retain possession. The landlord can legally deduct the daily rate from your security deposit.

Yes they most certainly can. It is possible that you could win in court but I wouldn't count on it. However this is not to say that you will ever have to pay them. The worse they could do is get a judgment filed against you but even those fall off of your credit after 7 years.
