You left out all the facts.

If the appliances were in your lease, then he has no right to take them, unless they were broken and he took them for repair or replacement. If he took them to be punitive, it's considered a self-help eviction, which is illegal. A landlord can't cut off your services (except while they are being repaired), take your doors, your stove, the light fixtures, the sink, etc as a means of getting you to vacate. It's illegal, no matter how much rent you owe. His remedy for non-payment of rent is to file in court and have you evicted. He's not allowed to forgo court and drive you out by making the place uninhabitable.

Did he just loan them to you? If the place came without appliances and he told you he had some extras you could use for a month until you bought your own or something, then they are his and he can take them back when he wants.

If you bought the appliances and he just showed up and took them, then you need to call the police immediately and have him arrested for theft.

I would think if you signed a lease that includes these items then it is illegal. Have you talked to the landlord? Are they replacing the items this afternoon?

He can't do that. You rented your place when it had all the stuff. Cut back on your rent if he's not planning to give it back. Or just call the cops or something.

No way he can do that, even if you are in the eviction process. Try to find some free legal counsel like Prairie State Legal Services here in Illinois.

I can't think of any circumstance where this would be allowed. Why would the landlord do this? Did they give a reason? Are they replacing them? It creates a serious habitability issue, and also a breach of the lease if major appliances are supposed to be included in the rent.

NOt enough info.
Did you rent apartment/house with appliances? You say my stove, etc.--did you buy them, are they yours? Generally they belong to LL, not to tenants, but some tenants bring their own appliances in.
If YES to any above questions, then LL can't do this.
Assuming you're delinquent in rent??? Even so, LL has no right to do this. Can fight it out in court, but. . . .you're not in a strong position of RIGHT if your rent is delinquent.

origamimark
If they belong to him, he can take them, but it seems like rather odd behaviour. What have you done to provoke him ? Are we being told the whole story ?

It depends on several issues. Is the stuff actually yours or was it furnished by the landlord? If it is yours then no, the landlord cannot take it. If it was furnished by the landlord, then it depends on the laws of the state, county, and city of where you live. It also depends on your rental agreement/contract; if you still have it read through it and find out if their are any clauses about furnishings.

Mr D
No, they would need court orders or police warrants.

if the stove came with the place, then yes. it's part of the landlords real property. If you payed for it, they cannot. If you replaced the stove with one you bought, before you move out, you have to restore anything you replaced.

He can do that if they were there before you moved in. He can't do it if they actually were your possessions.

Did they come with the apartment? If they did, yea it's legal.

icyownage@ymail.com
if they came with the house you could go to court with it, but chances of winning are low. if they didn't, and you bought them somewhere, yes. it's illegal.

Talat T
did it come with the house, and if it did, did u pay your rent, and if you did, did he give a reason?

if you need it back bad, id take your chances, ask for it, he says whatever and no, id call the police if it was a really bad reason.
