Angie M | Can a landlord come by to do her gardening if it is not on our lease? i feel she is envading our privacy? |
our lease does not state anything about having to allow her to come over and do her gardening. we feel like we are paying too much money to be treated as if we r just babysitting her house. i dont think that is fair. can we do something about this?? i know she can give a 24 hr notice but all the time?? Additional Details We are taking care of the yard. We pay for the gardener and we have timers that water even her personnel garden..onions, bananas, grape vineyard, lemons, orange trees. the problem is that she comes into our pation in which she looks through our living room window. Her garden is not in our enclosed patio. In the lease it states to keep up landscaping in which we do, it does not say she is come over whenever she wants to see it. We are to have no access to it , so therefore we are just using our water to baby sit it. She basically is just snooping. |

She does not have to give any notice to garden. She can move about HER land at will. 24 hour notice pertains to entering your home, not the land it sits on.
Most people would be really happy to have a landlord who was busy making your home look good. Be thankful for a great landlord, many of them really only care about money. |

Unless it is stated in the lease that you alone will maintain the landscape your Landlord has every right to maintain their property. Let me say this again. The Landlord has every right to maintain THEIR property. Doesn't sound like you would do a good job at it anyway. Another thing...what exactly are you trying to hide? |

Unless your landlord is gardening INSIDE your house, she doesn't have to give you ANY notice. Be advised that the 24 notice requirement only applies to entry to the interior of the premises.
She can come over and garden any time she wants. She's being courteous if she gives you a notice. |

She is not coming into your rented unit, she is maintaining her property. Be glad she does!

as long as she is not doing her gardening in your living room or kitchen then she can do what she pleases.
remember what you wish for because your next landlord probally wont' even show up when you need repairs done!
regardless of what you pay, because remember, you can move if you feel it is that bad. be glad she is using your rent money to give something back to the property you rent.
you can always ask her to come over on a specific day and time and see how that goes, but ultimately it is up to her to decide. |

If it is not written into the lease, you have specific legal rights to privacy except in an emergency.
I would contact a lawyer if you cannot resolve it with her. Have you come out and ask her to cease and desist?
Until you tell her to her face, she will continue as she has always done, especially if all her former tenants did not stand up to her.
Read your lease slowly and see if there is not a clause in there about her right to give that 24 hour notice. It should say something to the effect of "in an emergency or if the law is being broken, or if you have become a public nuisance.
Otherwise she has to let you live your life without her supervision. |
