Can a landlord come into a house while you are gone and not tell you?
I live in North Carolina. Someone said a landlord can go into a house without giving you prior notice. I think this happened. That 'someone' came into my house while I was out. I think it is illegal for a landlord to come in when you aren't home unless they give prior notice.

I live in NC as well (born, raised and lived here all of my life). I am also a (retired) NC Real Estate Broker...
The answer is no..unless it is written in your lease that he/she can. No one has the right to invade your privacy without permission from you, the renter. Unless the landlord thinks that there is a fire, or someone deceased in the home, there is no reason why a landlord would have cause to enter your home without your express permission. Should the landlord feel illegal activity is going on, he/she would have to go through the legal system.
Please read your lease and see what it says about your rights as a tenant.

A landlord must give at least 24 hours notice to enter you property, unless you have called and mutually agreed that they could enter. They can enter without notice if an actual emergency is in progress, as in your bathtub is overflowing and leaking into another residence as an example.

The rules will differ between states, but you should expect a 24-hour advance notice of an intended entry unless there appears to be a condition that requires more prompt entry -- such as a leaky pipe.

Usually, unless there is an "emergency" the landlord must give 24 hours notice. But if someone did enter how do you know it was him?

I think it depends on your state laws. I think, that since technically they own the property they have rights to enter if they feel that their property is in jeopardy. Usually it is common decency to let your tenant know though.

Where I live, yes they can. But they should be respecting your privacy and tell you they are coming in and for what reason. If it's to fix something, then fine. If it's to show the place because you are moving out, then fine. Find out why and ask them?

It is illegal - you should expect at least 24 hours notice for them to gain entry. (unless there is an obvious unavoidable EMERGENCY). Landlord's sometimes try to say that they own the property so they have a right but this is your HOME and you have rights too - they will (or should) be fully aware of this too!.

Hi there,

The only time a landlord can enter your property without permission is to protect his investment. Such as: any water leaking, frozen pipes, fire, smoke, power outage which would cause something to break in your apartment.

There is a gray area around this - such as the landlord could say he received reports your toilet was overflowing so he had to enter but, when he arrived there was nothing wrong.

Other than that - I agree with you 100% - I wouldn't want anyone to be in my house whatsoever - as long it was done with good intentions.

Landlords have to give you reasonable advance notice, typically 24 hours. However, no notice is required in the case of emergenies.

Perhaps you should send your landlord a letter asking if he entered without notice. Indicate that someone was in your home while you were out and you are very uncomfortable about this.

Not sure what the laws are in the USA, but in Canada they need to give you 24 hours notice to enter your rental suite.

WTF.... Landlord CANNOT go into ur house without first giving a notice and especially not when there is no one home. i dont know the laws in NC, but i know you can do something about it If you have solid proof that the landlord did went into ur house. If u cant proof anything but just know that the landlord went inside then i suggest you find a different place to live.

depends on what your lease says I think. mine clearly states that they have to give 24 hour notice and have my permission to enter.

You'd have to check the laws in your state and also review the terms of your lease. Sometimes landlords write into the lease that they will come in on a certain day of the month to do maintenance on the apartment. Generally though, no i do not believe they can come in whenever they want to without giving you notice.
