Croc | Can a landlord demand that I sign another 1 year lease after my first ends and not allow month-to-month? |
When I signed the lease agreement, I was specifically told that after my 1 year lease, it would turn into a month to month agreement. My lease is soon to end and now they tell me that they can no longer do month to month and if I wanted to stay in the apartment, I have to sign another 1 year lease. The signed copy of the agreemend does not specify anything about this. When I initially inquired about the month to month, as my lease is ending soon, they specifically told me, "as of this morning!!!we can no longer accept month to month after a 1 year lease (how convenient). I know this is pure B S, but wanted to hear something from someone who works in the field as I don't know how to proceed. Educated comments only please. |

I am a landlord. And you can not be forced to sign another year lease, and the landlord does not have to go on a month to month.
If you want to continue to live there, sign another year lease, if not then I'm sure the landlord will begin the eviction process.
I have all my tenets sign another year lease if they plan on staying past the existing one. And I have this conversation with them 90 to 60 days prior to the end of the existing lease.
If they choose at that time not to sign I, I will then give them formal notice at that time that they will have to be out at the end of the lease, so that I can have another tenet move in. |

Either way...make sure you give notice....your lease should specify 30 or 60 days.....that you don't intend to renew.....
with the glut of apts and homes for rent....they'd be idiots not to hang on to you for as long as possible....
The downside....if you do stay as an "at will" tenancy....they can increase your rent EACH AND EVERY MONTH....up to 20%...w/ 30 days notice....
And it's NOT in your current lease that you get to go month to month anyway...so they don't have to....they're idiots, but it's their perogative. |

THE BASIC PROBLEM IS THAT IF YOU CHOOSE NOT TO SIGN A NEW LEASE IT WILL LIKELY BE THE LANDLORD WHO CAN,AND WILL, INVOKE THE MONTH TO MONTH PROVISION AND YOU WILL HAVE 30 DAYS TO FIND NEW QUARTERS....OF COURSE THEY CANNOT MAKE YOU SIGN A NEW LEASE BUT CONSIDER THE CONSEQUENCES SHOUKD YOU DECIDE TO NOT DO SO. |

Doesn't matter what you were told, the law always trumps anything verbal.
In this case your landlord can absolutely demand that you sign another lease for a year, you don't have to accept it, you can negotiate, but if the owner says 'nope' you're going to have to move out.
If your landlord never approached you about renewing the lease, the law usually defaults to an assumed extension which is identical to the first lease you signed. (Varies from state to state and country to country) Sometimes the law might say the default is month to month - it depends. You'll need to check for your area. If the landlord or agent approaches you, then you are out of luck on that point. |

Unless the written contract had the month-by-month clause after a year written it, it will be hard arguing it out, especially in court due to lack of physical evidence. He can deny anything you say about the verbal "agreement" was, and it would be hearsay anyway. |

Once the lease expires the landlord/tenant relationship ends. Just like the landlord can't force you to sign a year lease, you can't force the landlord to sign a month to month lease. Either move or sign. |

I'm curious to see other answers, but I believe they have every right to do this as long as you are notified at least 30-60 days in advance of the expiration of your current lease. I also believe that if you continue living there beyond the lease expiration date after notice has been given, it will legally be construed that you accepted an additional year.
I'm not a lawyer, but this comes from my experience as a renter and from business law classes I took. However, I'm sure the laws vary from state to state, so you should check with your state housing authority. |

No they cannot. After your first year, your are allowed to go on a month to month, but the rates will probably be different. Or maybe thats just here, because we have no rent control.
But in any case, they can not force you into another contract. Just call Landlord / Tenant courts, or Housing Authorities, and seek free legal help, and options. |

Hi! I was a property manager for years. They cannot demand you sign a years lease but you probably can't stay unless you do unless you can prove they stated you could go on a month to month at the beginning of your lease. If it isn't on your original lease you will have to sign for at lease 3, 6, or 12 months I'd say. Some companies over short term premiums also for that short of period. Ask them if them have 6 mo. lease and what the short term premium would be.

they can only do that if its in the fine print of your contract if not you should be locked in untill your lease is up. but if you have mo to mo then you should be able to stay that way untill you decide to leave as long as you abide by the contract you should be ok.. |

I work for Kettler Management and our policy at my property is if we do not hear from you regarding your renewal plans by the time your lease expires, you are automatically considered month to month with an extra month to month charge on top of market rent.
Depending on your landlord and the management company that handles your apartments, the rules may be different. According to my knowledge, they can not make you sign a one year lease or evict you because you will not renew for another twelve months. Especially if it is not documented on the initial lease agreement you signed.
Speak with management and go to corporate if you have to. There must be other options out there that offer more than a twelve month lease, perhaps a three, six, or nine month lease as a compromise for twelve. |
