i am in a one year contract and only volated the rent agreenment once it was late by 2 days cause of how i got paid (bi weekly). the eviction notice says cause i did not pay junes rent of 248.00 and i did i have the cashiers check right here . i did call him he said he had to do this cause i did not pay when i did pay.i have no complaintes the ppl i live around are all old and understand that my 2 year will make some noises i also have a 3 week old. and i live in a fixed income house i even notifed that i had no income that was in janurary that i will b done will work on may 11-2007.still they have no filed to lower the rent since it is a income based house.. |

heck no.I went threw that myself, and i learned a lesson always keep receipts and make sure it's no complaints.My landlord gave me an eviction for not paying rent but i did and he didn't look at the papers so i took him to court and won!!!Go to tenets & landlord court and i bet you would win!!! |

I would suggest reading over your lease again. If you violated your lease, he may give you notice to move, if it's offensive enough he can evict you. However if it was due to late rent, once rent has been paid, most management company's or landlords will contact the courts to notify rent has been paid and there is no need to appear in court and it just goes into your file. If your landlord has filled numerous evictions upon you, this may be action enough to continue the eviction.
You best bet is to call your social worker to find out the details, I'm almost certain subsidized housing has their own set of rules, at least in MN they do.
I wish you luck and please contact your social worker or housing agent.
Those kind of actions remain on your credit report for a very long time.

Whats he evicting you for? If you have no lease, or it is a month to month lease he can evict you just to get the place back, but typically he has to ask you to leave first (in md he must give 30 days notice before he can begin eviction, but not sure about wisconsin).
Just call him up and ask him what he is evicting you for (or does the eviction notice itself say what the eviction is due to??) |

he can evict you for no reason. but if you have a lease. he or her. must give you 30 days to move. at the end of 30 days if you don't move out. then they have to go to court get you out. they will serve you papers law. then you go to court. then the judge will give you at lease another 30 days to move. make them serve you the papers. so lets say you got eviction notice today. you have 30 days. then after the 30 days you still there it may take week get served the papers from the law to go to court. then it may be 30 more days before you go to court. then judge may give you 30 days get out. run time out. good luck |

If you violated the terms of your lease, then he can do that at any time.
Additional: Do you mean you have the receipt from the cashiers check? Because if you have the cashiers check, then you haven't paid June's rent yet, seeing as you would still be in possession of the money. If you have the receipt only, then that still isn't any assurance he cashed it or even received it, which is why it is always best to get a receipt of payment from the landlord. So, you would need to first show that he did indeed receive payment for June's rent, and you might need to further show that it was received in a timely fashion. Find out if and when the check was cashed.
You should take note that just because your neighbours haven't complained to you directly doesn't mean that they haven't complained to the landlord. There are such things a lying and being two-faced. |

If you signed a contract Saying you would not do something and you did it anyway, Yes, Even though you paid the rent for the month He can, Do you have a copy of the rental agreement? If you do, Take it out and look it over and see If he has grounds, If Not Then you have a right to challenge His eviction notice, If you dont have a copy then you have a right to ask to his copy and show you where you broke the contract. At the very least if you still have to move maybe he will Pro rate your rent so that you dont lose monies paid for the full month..Good Luck to you.. |

Then when you understand the rules of the lease call your local tenants rights council and rent board to see if the landlord is simply bullying you. Once he understands that you know your rights when will be much more careful |
