If your wife is renting the place than she has the right to invite you over so I don't think he can get you for trespassing. Renters do have rights, more than many people realize. There are different laws about contracts if you are married. In many ways wife and husband are one in the same when it comes to contracts, not sure how it would apply on a rental but on home ownership in most states even if one is not on the deed a husband and wife still share ownership. |

You are an unauthorized occupant. Absolutely you can be served a trespass notice plus the leaseholder is in non compliance and can be evicted. |

Yes. Not being on the lease but living there qualifies one as an "unauthorized" tenant. The landlord may/may not have been o.k. with it till now, but there's no law saying the guy has to STAY o.k. with you living there. |

Yes.
Leases often require that everyone age 18 or older be named on the lease. Otherwise, you count as a "guest," not a tenant.
So, in addition to you being charged with trespassing, your wife could be charged with breaking her lease, and thus be evicted. |

If you are not in the lease agreement, and if the landlord has not agreed that you can stay there, then yes, they can file a trespass notice.
