Can a landlord install used appliances when new ones were promised?
I signed my lease w/o appliances installed yet. I was told new ones were going in, and still have the advertisement that says "New Appliances". Instead I got old dirty ones that clash with my kitchen. I've pointed it out but they have no interest in replacing them. Can they do that?

The advertisement can say your apartment comes with the Queen of England, what does your LEASE say about appliances?

Uh huh, go on I'm listening

If they work proerly, there isn't a whole lot you can do.
it is not right of them, they advertise "new", but fact is, you took the place before the stuff was in. that's where you'd have a hard time in court if it ever goes that far.... never sing along the dotted lines till you are completely satisfied and see end results first!
I'm not saying you can't fight them, but it will be hard and cause anomosity w/you and your landlords. Best just clean them up, and leave it be, you could also paint them with a heat resistant paint (look into types first, be sure to get the right one) hey they gave you old ones against their word, why not!? lol, I would!

handsome_bigfella
LOL @ ihkds...

But he is very right. If the lease didn't say it then you're SOL.
Time to either get over it or plan your move somewhere else.

It all about the lease!!!!! But I would let them know that they adverrtised with new app. and therefore if they arent going to get them they should drop some off of the rent. Keep the copy where they advertised!!

if you have it in writing, contact a lawyer (usually a consultation is free). or you can threaten to move out, depending on the rental market, the apartment may go vacant for months.

my next door neighbor (i own a condo) walked away last july, they foreclosed, the sherif whacked off the door locks last october. it still sits vacant (i have no idea if the bank owns it or the association, but it's quiet :-)

woman38
sounds like you have it in writting
they can do it if they can get away with it

If it is in writing, I think you can withhold rent until it is fixed but check with your state rental laws first. You can't just get ones that match though. They have to be not what you asked for in newness.

Mercy
nope they cannot

they must put it what was on the agreement (that should be signed by both parties)

if they refuse when it is agreed and signed, report it to your local council/borough

Tim
You could sue for "bait & switch", misrepresentation, fals advertising, etc.

Keep the original of the ad. Make a copy and send it to the landlord with a letter demanding new appliamces like stated in the ad.

You then have the option of bringing suit or asking to be let out of the lease.

FRANK
This appears to be false advertising. You can report this to housing authority. Show them ad, and bring pictures of one that were installed.
