Can a landlord just demand access to a property..?
For example can he send a letter to say I will be coming on the xxth of november to inspect the property if no one is there I will gain access myself.
I was under the impression the landlord or their agent was required by law to respect the tennants right to privacy etc. At least thats what I was told by a barrister..

In any case if whatever the legal positon actually is can you provide some form of evidence of its origin.. For example which statute is being quoted etc.. As I am finding this to be very grey area.

As long as you have 24 hour notice he is not violating your privacy and has every right to inspect their property. He can no through your dresser, but he can inspect his house, the structure, appliances and rooms themselves.

You do not need to be present.

Hi,
If you go to your local library you will find that the "grey area" you talk about is absolutely black and white, and it can be found in your state's Landlord tenant laws. Yes, a Landlord can in fact enter your space that you rent to do inspections. It sounds like you have a good Landlord seeing that proper notice was given. In fact it was in writing, so you have to let them in even if it was verbal. Don't forget the space you are renting is NOT yours. It belongs to your Landlord, and they are entitled to inspect by law, so don't think you've cornered the market on real estate quit yet.



I see a lot of down thumbs for perfectly good answers. Laws vary from state to state, but a Landlord can enter with proper notice, and NO notice in case of emergencies. And that is fact. Check it out for yourself. Any down tumbs for this answer just shows ignorance.

Yes they certainly can do this, especially if they let you know ahead of time. The exact law would very from city to city. Call your local municipality and ask to speak to the housing department. Here is what my city's ordnance is:

5. To enter the rental premises of any tenant
during the tenancy to inspect the premises, make
repairs, or show the premises to prospective tenants
or purchasers, as authorized under §704.05(2),
Wisconsin Statutes, at reasonable times upon twelve
(12) hours advance notice. Entry may be upon less
than twelve (12) hours advance notice where the
tenant, upon being notified of the proposed entry,
consents to a shorter time, where the tenant requests
or consents to a proposed entry at a specified time,
where a health or safety emergency exists, where the
tenant is absent and the landlord reasonably believes
that entry is necessary to protect the premises from
damage or where entry is otherwise authorized in
writing other than in a form provision in a lease.

For the uk it's 24 hours. If you are on holiday etc on the date he's suggested then rearrange for another date/time. Simple.

He has given notice of when he is going to visit and inspect the property, I don't see what the problem is.

A land lord can give a 24 hour notice to gain entry and yes they can come in after that 24 hours but they can only come on that day and the notice should say what time they should be arriving. I got caught in the shower they came in at 9 AM He knocked but I did not hear it so they came in with their keys

as a student Ive dealt with this before and (it was along time ago) they are allowed if they give you reasonable notice. no turning up unannounced or calling you that day i think is 24hrs written notice or something landlords have got the power ...basically... its there property

As long if he has giving you a date of two weeks or more he can enter the premises. It is up to you to make arrangements to be their or ask for a specific date that works with your schedule. He is not demanding access,

I you lease it should state the Landlord has the right to access for the following reasons:

1. Emergency not prior notification is required but they need to leave you a entrance slip and for what reason. Example Apartment below flooding, could be that you have a pipe in the wall that sprung a leak and is flooding your underneath neighbor.

2. In addition they have the right to enter with proper notification in written form. Example: Company requires a yearly in unit inspection at that time they will check for leaks faucets or toilets as well as water damage and mold, settlement cracks, Smoke detector test and what ever else may be on there requirements.

The reason most Landlords do this is because of several reasons. There financing requires them to do preventive maintenance and inspections or they are having a bank inspection for re-financing and they want to see 50% of the property and the bank doesn't tell them what buildings or addresses so they need to be pre-paired by notifying all residents or they could be having a code inspection to maintain there business licence. That is when the county comes out to make sure the landlord is maintaining the property.

i think the rules change from place to place. i know in California that a landlord simply has to give you 24-hours notice and tell you what exactly they are going to be looking at. you should ask people that know specifically about your area.

The Landlord has no absolute right to intrude into your property His only rights to enter during tenancy are:
a. when Tenant agrees
b. under s.11(6) of the Landlord and Tenant Act 1985 [24hrs. written notice asking for T for daytime access so L can inspect installations which he is responsible for repairing].

Certainly Landlord cannot just to show property to prospective purchasers or tenants. This is not only trespass (civil wrong) but also harassment (criminal offence).
• In a true emergency (boiler suspected not working is NOT an emergency).
• If the tenant permits access.
• If a court orders access.
Also if you do not want the landlord in the property and tell him so in writing, he or his agent, cant not enter. If they do it is trespass as above.

Contact shelter, they too will give advice. THIS IS UK ADVICE.

Depends on the state. Here in Indiana, he can come in, but he can't let anyone else in (I.E. the police) because it may be his property, but it's still my stuff.

when you rent a place, you have the right to rpivate property. if your landlord thinks they can just come and go as they please, it's trust passing.
