Can a landlord keep your personnel property?

it depends on the state most state will allow a landlord to keep a renters property as collateral if rent is unpaid. however a land lord cannot keep item that are a necessity for survival (clothing and bedding) and most likely they can charge you for storage

Look at the abandonment clause in your lease. If you moved out and left your stuff behind, after 15 days a landlord has the right to store your belongings and charge you a storage fee. To get your belongings, you pay the storage fees. 15 days is enough time for you to get all your stuff. If after 30 days, the landlord has the right to sell any belongings if you havent paid the fees and retrieved your stuff. Anything not worth selling can be put in the trash for pick up. You cannot expect a landlord to store your stuff for free. You, alone, are responsible for your belongings, not the landlord.
My advise is pay the storage fee and retrieve your stuff. If not, you only have yourself to blame. You are no longer his tenant, so he could care less if you get it or not.

Yes and no- it all depends on how long your property has been there, and whether or not you're paying any form of rent.

If you've left it there for a significant amount of time, it could be considered abandoned, and they legally have no obligation to keep it for you.

I'd advise either removing it immediately or seeking the advice of a lawyer. This sounds like a bad situation about to get worse.

Seek the advice of a lawyer...

A landlord can hold your things until an outstanding balance is paid.... and in some cases they try to charge storage fees. (this is why you need to talk to a lawyer) depending what is in the place where your landlord is keeping them, like TV stereo, computer things like that, have a friend go and tell the landlord that the items were lent to you and they want them back....

but you should consult with a lawyer first, (free consultations are good for these type of things)

There are strict laws protecting the tenants rights with regards to personal property. Personal property may not be withheld by landlord for any reason. Landlords must take reasonable care to store property that has been left after vacating the property. Personal property may never be withheld in lieu of unpaid rent and utilities. There are specific steps a landlord must take in order to dispose of perceived abandoned personal property, and the key word is reasonable. Notices must be sent out to last known address, address where property is left and all know properties to find the owner of the personal property. All states may vary in under the law when it comes to tenant rights, but these are most likely the norm for all states. Check your states tenant and landlord laws for more specific details, and take that landlord to small claims court depending on the value of the property.

you should always do a written agreement and make several copies. Just call the police to go with you and order they give it back. always save receipts for things you purchase to prove they belong to you.
