In a word, no.

Even if your rent is late, the landlord cannot enter your apartment (a) without 24 hours notice and (b) without good reason, i.e. emergency, inspection, showing prospective tenants.

Yes and no. A landlord can post an eviction notice. If, after one month, the rent has not been paid, the landlord can bar the premises and move the contents into storage. The cost of storing the contents can fall on the tenant. If the tenant does not pay for storage, the owner of the storage facility can sell the contents.

No, he cannot, unless very specific language in the lease agreement allowed for this type of action -- and even then, I'm not 100% sure such an arrangement would hold up in court. Unpaid rent does not legalize burglary, and it sounds like that's what's happened to you. I would call the police at once. If the landlord wants to recoup his rent money, he can do so legally, through the courts. He has no right to seize your property as if he were the IRS. DON'T WAIT to contact someone about this.

If you are talking about an apartment rental, No he cannot, not until he's received a "Writ of Possession" from the courts he is not legally allowed to enter your premises without your permission. Thats why LL have to file in court they have to get posession back of their unit, if you haven't been legally evicted then he does not have posession of your unit, YOU do.

Legally he has to file eviction thru the courts, have a hearing, get posession back of the unit, give you 24 hours notice to vacate, then if you are still there the sheriff has to remove you from the premises, anything you haven't removed becomes the landlords property. Any monies owed he has to receive a judgement from the courts to place on your credit.

He cannot go in and take your things that's stealing and it's illegal.

If you are talking about a storage facility with a company like U Stor It, then yes they can. They can put a lock on your unit and prohibit you removing the items until they have received payment, if you fail to pay, the Storage company has the right to sell off your items at the next auction to recoup their money and you lose everything.

Absolutely not! Though it's unfair 4 a tenant not 2 pay, it's illegal 4 a landlord 2 enter the premises & take & hold...That's theft! Take the tenant 2 court to recoup unpaid rent & get them evicted--legally. Hope this helps! :-)

Yes..actually he can. But first and foremost Landlord and Tenant laws vary from state to state so check yours!!! What a landlord can do in Florida is not necessarily legal in Georgia.. Once the Landlord has went through the proper court proceedings served an eviction notice so on and so forth.. and has obtained a "writ" to once again possess the property then one can do so even if your things are inside. Also check you lease!!! again i say CHECK YOUR LEASE. leases are written in the interest of the Landlord and will almost always be beneficial to the landlord in the end and not the tenant. and they have lots and lots of fine print. If it's written in a lease that a landlord can hold personal belongings until all unpaid rent is collected then YES they can..even without court proceedings because it's in the lease and if you signed it then it's legal and binding. last but not least call a lawyer that specializes in landlord-tenant law and ask them for advice..they will be able to answer your questions according to the laws for that specific state!!!

I do not believe the landlord can do this but they could call the sheriff to possibly hold some stuff or seize for them as collateral.

Yep. My buddy lost all his stuff that he had in a storage unit because of this. Rental housing is the same. At least here in NC anyway.
