I am 1 month behind on my rent and my landlord left me a message saying that if I don't have the money by September 10th he is going to come in and take all my furniture and TV and what not. And hold it as collateral and/or sell it to get the back rent. I have not received an eviction notice or anything. Is he legally aloud to do that in the state of Virginia? Wouldn't he have to go through the courts first or give an eviction notice or anything like that. I have spent hours searching yahoo and google but can't find anything. Any help would be greatly appreciated. Thanks |

While you should pay your rent, 1 month isn't really THAT bad. I mean, it is bad, but not like 3 or 4 months bad.
It is illegal for him to touch anything of yours, and especially illegal for him to sell it. That would be considered stealing.
You can't really say much though, you're in a tough situation. If you did tell him that it's illegal and you will call the police, he could evict you.
Best advice is to pay your rent...

I hope you did...make sure you can get it on tape b/c that is important.
Make sure you inform him that if he does so, you will call the police and have him arrested for not only breaking and entering, but theft.
You may want to go ahead and call the police now and file a report...they won't do anything, but they will take a report, and you'll need that later in case your landlord does something.
It is NOT a civil case if your landlord does this...it's criminal.
NO STATE permits a landlord to do that. |

he cannot take your personal property without a court order. he has to have you evicted . this is a threat he is using to scare you. you have to try to pay something on the back rent even it is partial payment. good luck |

Absolutely not. When I first read you question, I thought, wow, this must be from another country, I wonder if I'll be able to answer? But you're in America? It's called private property for a reason. Let him do it, you'll be able to sue his pants off!!
But you need to pay your rent, he can evict you and sue you for the rent and legal fees. And it's a bad mark on your credit. |

NO. The landlord may never take your personal belongings for collateral or any other reason.
I would call the cops if he even tries to take any of your personal property. |

Where is your tenancy agreement. All the answers should be in there.
Remember you are allerady in breach f your contract by not paying on time.
I am a single parent with debts, but I allways pay my rent.
Instead of researching your rights, pay the rent. Go and get money, sell something, get a sub from your boss.
Failing that, communicate with your landlord and show him that you have every intention of paying and working hard to makesure this doesn't happen again and comeup with an agreement, like pay next week rent ok but add a payment towards the rent you missed in small amounts (preferably one where you end up giving him more than the rent was in the first place to compensate him for the inconvenience)
