They cannot lock you out without a court order. You have to have breeched the agreement, been given notice of the eviction, an opportunity to answer their complaint , receive the judges order and be given time to move out. |

You can't be locked out without a court order.
If they change your lock or set your stuff outside, go to court and ask for an emergent hearing or an order to show cause. You will be granted re-entry into your apartment and you may be able to have your landlord arrested.
Where I live, they arrest landlords who do self-help evictions, and if your stuff gets stolen, the charge goes from a misdemeanor to a felony. |

Only a sheriff officer with a court order eviction can legally lock out of of your rental, any lock out by the landlord or the landlord's agents is illegal and called self-help, if they attempt this call the police retain a lock smith and re-key the lock then seek legal action against the landlord |

The landlord should be giving you 30 days notice to leave the premises. An eviction takes typically 3 months to go through and they cannot lock you out until the eviction order has been made. |

It may vary from state to state. But here in the state of Texas, the landlord has to give you in writing a 3 day notice to move. Then after 3 days, the landlord has to go to the courthouse and file eviction papers. You will be notified to appear before the judge at a later date. According to the judge, you will have 30 days to be moved. If you are not out within the 30 days, then the sheriff's department will arrive and make sure you have your stuff out. The landlord can not legally place you or your stuff out without orders from the court. |

June, get offline and look up Legal Aid in your phone book. They will know the laws about removing tenants for your state. In many places, there's a strict procedure and a landlord--even one who hasn't been paid in months--can get in serious trouble for doing what yours is doing today.

I don't know what state you are in, but in California they can not put you out or lock you out unless you are an illegal squatter. If your name is on the rental agreement then they must go thru a proper eviction procedure, which takes 30 days. If they proceed to try and lock you out, then you have a valid lawsuit against them. If any of your things are lost or damaged due to their actions they will be libal for replacement costs. Quickly take pictures of all your rooms and your stuff and keep the pictures somewhere besides your residence.
Now you know that eviction is starting you'ld better start looking for another place. Don't wait--do it now. Thirty days is up rather quickly. |

The land-lord can only give you a 24hr notice if he/she does so with the law on site to prove you are using the place to hold any type of activaty that brakes the law.
as for the 2nd part the land-lord must hold the belonging's for 14day's,at the end of that time he/she can do as they see fit with the item's.
How-ever,These law's vary from prov, to prov,so it's best to
get ahold of the landlord's and renter's aid to be sure of the law in your area!. |
