Miss Mayhem | Can a landlord tell you to keep your house tidy? |
I got a letter from my landlord saying my house was "unkempt" and saying I had 30 days to bring it back to a presentable condition. We are talking about the inside, as they had sent someone over for repairs, and it was reported back to the landlord that the house was messy. There were boxes and things piled in our living room, because we had just gotten things out of storage, and my kitchen was a mess when he came over because my husband had been sick... and well... I had just gotten back from California... Husband + Alone in House and Sick = Disaster area! LOL
Anyway, it's tidy now, but the landlord said we have to have another inspection which we need to pay for.
Also, he is saying we have to get the carpets cleaned once now - and then as well before we move again. If we don't comply in 30 days, then we will be evicted.
Can they do this? |

No, no and again NO! You rent, the place is yours and upon vacating (as per a standard lease) an inspection is done. You lose your deposit and if it is super bad and provable they can sue for more. Inspections during the lease are illegal (it is an invasive sort of thing) unless the landlord files the paperwork to just have you evicted. Any inspections, repairs or whatever have to be paid by the landlord.
Any smart landlord understands all of this and realizes that going through any sort of process will cost tons of money on their part. Unfortunatly there are those who prey on others ignorance of the laws.
Now that your house is tidy take pictures of the whole house. Each time you speak to the landlord write down the time and what was said. Even if it is you leaving a message. This goes a long way in court and you should be thinking that way if your landlord is being that way. Call the local housing authority and ask them questions as well. Odds are your landlord will back off all of the way as he will realize that-
-Even with eviction he has to let you stay for months.
-To evicte will cost a whole lot of paperwork and time
-And if you have a paper trail and note who you speak to he may even have to pay you money |

That depends on what your rental lease says. I've had one or two that stated very clearly that the house keeping was to be maintained at all times and if outside sources had to be called in, it would be our responsibility to pay for such services. Check your lease. If its not in your lease, they cannot require you to pay for anything that he requests. However, having said that, if there is anything that is effecting the structural integrity or support of the building and that's what they're having the inspection for, AND IT'S YOUR FAULT, then yes he can make you pay for it. But all of those things have to be the case. It has to be negatively effecting the structure or support of the building, and he has to prove that it's your fault. Otherwise he has nothing. Granted, they can tell you what to do with what is visible to others (like your deck, patio and yard) but if it's not publicly visible and it's not in your rental agreement, he can't force you to pay or do any of the other things hes requesting. My advice, check your rental agreement. |

Some landlord are way out of whack, I assume we are talking USA, there are a couple of things to look at
1st: read the lease agreement that will be the controlling authority on what the landlord can and can not ask of you, what does the lease say about clutter? now their could be a side issue if the place messy on what type of messy if food all over the place, which could lead to insects, animals then even if the lease does not address it could be seen as a health code violation
if you are talking about clutter on the lines of boxes in rooms, unpacking non-food items then no unless the lease explicitly states no clutter, can they now state you must do x, they and you are bound by the four corners of the contract, the landlord after the fact can not add new terms until the lease is up
As toward paying for another inspection ask the landlord where under the lease terms does it state you must pay for another inpection if it does not state it you are not bound to pay for it
if the lease does not address either: clutter, paying for second inspection, cleaning carpets durring tenancy, let him move for evcition. 1st usually eviction for other then non-payment of rent require, notice to cure must state the lease provision you are in violation of and give you a change to cure, if the lease does not state it then no case
but if the landlord moves ahead, you must show up on the court date, failure to show will lead to defeault judgment and you will loose the case even though on the merits you should win

Unkempt does not equal a health and safety hazard.
Pay for an inspection? That's insane.
Same thing with carpet cleaning upon his demand. He doesn't have a say in how often you have to clean the carpet.
If you haven't damaged the carpet, he's not going to be able to evict you simply because you don't shampoo it on demand. If you actually damaged the place, that's a different story, but it doesn't sound like you did. |

It all depends on your rental agreement, this is were your answer lies, check it out and then present a copy to the landlord asking where it shows you have to comply with his demands. One thing a Friend of mine did with his lease disagreement was he went to a lawyer and had them mail a copy to his landlord asking for details on where it said he had to do certain things to retain his security deposit, that shut them right up. Lawyers will do this for next to free, because if you have future problems they want you to contact them. Good luck with this, Jay |

Yes he can. Since the landlord owns the property, he is responsible for everything that happens inside of that property. Since there will probably be tenants living in that house besides you one day, he wants to keep it as nice and tidy as he can, so that he can attract another tenant. This is probably the way that your landlord makes most of his money so you should respect his rules and regulations before he decides to kick you out. |
