Was the vehicle disabled? Many complexes do not allow cars that are not in working order, proper tags and stickers too, to just sit in the lot. I would guess if your brother didn't know the car was gone it was a car that didn't work well or had other reasons for sitting idle. Read your lease-it is likely spelled out in there that you aren't allowed to leave a car sitting for x number of days or perform car maintanance in the parking lot. |

The only thing you can do is to get it out of the tow yard and sue your landlord.
Keep in mind that you can't just let it sit there and rack up storage fees and expect to collect it. |

Does your lease have parking restrictions? What are they? Most places require a SIGN stating what the parking restrictions are, or that they exist; and where to call.
If there's no sign, I think your landlord has to pay for your towing bill. |

Was you brother the tenant? Was this a new car?
Many times the tenants need to let the landlord know what the are driving or display a permit. Without it, the landlord must assume that the car is not in the proper place. |

Unfortunately, a landlord can do things like this, but if you had his prior approval, I don't see why he would double-cross you like this. I'd find another place to live if someone did this to me after he had already said it was okay unless the tenant asking the favor didn't tell me the entire story. If the landlord didn't know who the car belonged to, maybe this is why he never informed you or your brother as to where the car had been towed. Anytime a car sits in a storage lot, the cost to get the car out of an impound storage lot is going to rapidly
accumulate on a daily basis and it is going to cost you more money. Didn't your brother ever go out to check on his car to see if it was still where he parked it? Was the car not in running condition? Perhaps you should have introduced your brother to your landlord, told him that this was your brother's car and ask if it was still okay if he parked there for a certain length of time. For some reason, I don't think we have all of the facts here to answer this question. But yes, a landlord can have an unknown vehicle or any vehicle not being used towed if it is parked some place that you had to obtain special permission. Usually, there is guest parking provided for the tenants unless this car has been sitting there for a while, unmoved, wasn't in running condition, presented an eyesore for the other tenants, or if it has been there for a long time as if it was abandoned. |
