Can a landlord under foreclosure evict non-paying tenants?
If an owner of a condo is currently under foreclosure and his tenants find out and decide to stop paying him can he legally evict the renters?
Additional Details
Ok, it is not me not paying my rent. I am a mangaer at co-op and we have a dirtbag owner that has like 20 units under foreclosure and he is still renting and collecting rent. Just wondering why he can still collect rent when he isn't paying. Unrelated he is also not paying HOA fees and we have to legally go after him for renting without paying fees

Landlord
Yes he can collect rent, evict and sue for non-payment. His contracts with his banks do not effect his leases.

the landlords foreclosure situation should have no bearing on paying rent that is due - they live there, they should pay - they should also be preparing to possibly have to move suddenly

mark
The two are unrelated. Yes, you can evict the non-paying tenants. And you still have the liability to pay your mortgage

Proud Mommy
Yes. Until the property is completely taken from him.... He is still there landlord and can evict.

Yes he can since you stopped paying your rent. It doesn't matter what his financial situation is, you still owe your rent.

SmartA$$
The two situations are unrelated. If a tenant does not pay rent, the landlord can evict the tenant period.

The fact that the bank has started the foreclosure process means nothing to the tenant. The landlord still owns the property and rent is still due to the landlord.

Once the foreclosure is completed and the bank officially and legally takes ownership of the property, then the former landlord does not own the property and cannot collect rent for it. At that point the tenant is left to sort out the situation with the bank that owns the property, and the laws that govern this situation vary from state to state.

The key here is that until the final day of foreclosure when ownership legally transfers from the landlord to the bank, the landlord has full legal authority to collect rent and evict non-paying tenants.

joscasta
Yes, since they are breaking the lease agreement with the owner. I would find out from your local housing association about how to go about doing this legally.

The foreclosure and the lease are two different things.

schwildcat1977
YES! The foreclosure has NOTHING to do with the rent. Tenants are still legally required to pay rent until the guy no longer owns the property. If the tenant stops paying, then they get evicted. PERIOD! There is no gray area here people!

It may not seem fair - but it is the law.

Yes, Foreclosure has nothing to do with the rental leases. They are still valid until notice is given by the bank - they are the ones who will terminate the existing leases after they have taken possession of the property.

Check with your state's housing authority. There are some states that have laws preventing eviction of renters as long as they continue to pay rent.

if the property is in forclosure then there might be some play in negotiating with the owner or you might have a right to not pay depending on your state laws. however being in forclosure and not making your payments to the bank is a whole diferent ballgame. I know of investors out in california who havent made payments to the bank for over 7 months and still havent been serviced with an NOD (Notice of default)

He (landlord) will not evict the renters however the bank that is now in possession of the condos will be serving evictions to all tenants

make sure in some cases there is a moratorium on foreclosures until after the holidays.

Now let me get this right, you want to know if you quit paying rent, can a landlord evict you? What kind of stupid question is that? His foreclosure is probably due to people not paying, don't you understand how this works? You pay him, he pays the bank. You don't pay him, he doesn't pay the bank. And there you go, foreclosure

Misty C
No. Under a foreclosure the lender temporarily owns it..
