If an owner of a condo is currently under foreclosure and his tenants find out and decide to stop paying him can he legally evict the renters? Additional Details Ok, it is not me not paying my rent. The two situations are unrelated. If a tenant does not pay rent, the landlord can evict the tenant period.
The fact that the bank has started the foreclosure process means nothing to the tenant. The landlord still owns the property and rent is still due to the landlord.
Once the foreclosure is completed and the bank officially and legally takes ownership of the property, then the former landlord does not own the property and cannot collect rent for it. At that point the tenant is left to sort out the situation with the bank that owns the property, and the laws that govern this situation vary from state to state.
The key here is that until the final day of foreclosure when ownership legally transfers from the landlord to the bank, the landlord has full legal authority to collect rent and evict non-paying tenants. |

YES! The foreclosure has NOTHING to do with the rent. Tenants are still legally required to pay rent until the guy no longer owns the property. If the tenant stops paying, then they get evicted. PERIOD! There is no gray area here people!

Yes, Foreclosure has nothing to do with the rental leases. They are still valid until notice is given by the bank - they are the ones who will terminate the existing leases after they have taken possession of the property. |

Check with your state's housing authority. There are some states that have laws preventing eviction of renters as long as they continue to pay rent. |

if the property is in forclosure then there might be some play in negotiating with the owner or you might have a right to not pay depending on your state laws. however being in forclosure and not making your payments to the bank is a whole diferent ballgame. I know of investors out in california who havent made payments to the bank for over 7 months and still havent been serviced with an NOD (Notice of default) |
