please do not follow any of the big e advise . this individual has a real issue with handicapped people enjoys to make physical threats not much to count on for advice . the landlord on eastren states call call and ask for permission within a 48 hour time frame . at your convience . if it is for installation or upgrades landlord or managers must stay and observe installers . contary to what big e states the have no legal right unless it is for alarm purposes . written permission forms are required to be singed . i hope that this does help if you do plan to move have city advised of this situation , could be illrgal apartment , or possibly thr building owner himself . this would stop your manager since unemployed post haste . |

No. This is not okay at all. If you have a copy of your lease, you need to look at it and read it very carefully. Chances are, if it is a legitimate lease, it will have a clause regarding conditions in which the landlord is allowed to enter your residence. Typically it is when they phone in advance to let you know when they are coming to do repairs, show the apartment, and the like.
I am not aware of any clauses of any lease contracts I have read that allow the landlord the ability to enter the premise whenever he or she so chooses, especially in the conditions that you describe.
I suggest telling your landlord that you do not appreciate him barging in and the way he was been acting. From now on, you need to be notified 24 hours in advance when he is planning on coming, and for what reason. Stopping in just for the heck of it is not a valid reason for a visit. If he says anything to it, just let him know that you are not sharing an apartment with him. You are paying him for an apartment for your family, and he is not one of them. If his behavior continues, you will be contacting the authorities. Let him know that this is his warning.
Again, make sure to read the lease. I hope things turn out well. |

Hmm.. If the situation gets any worse, you must contact the police. The landlord can enter the apartment with only specific reasons. Example, to collect rent, or fix anything. Otherwise, its completely illegal. I suggest, you talk to him sternly about this. Have a lawyer or your boyfriend with you when you do the talking. Show him that you are not to be messed with. :-) |

No, a landlord does NOT have free access to an apartment that he is renting to a tenant. He is not supposed to disturb what is known as your "quiet enjoyment of the premises." He is also not supposed to go around nosing into your belongings when you are not home. Examples of times when a landlord is allowed in your apartment is when there is some work that needs to be done, or something wrong in your apartment which could have an impact on other tenants or on the value of the property, or when you have advised him of your intent to move and he needs to show the apartment to other potential tenants. In this case, he does have to give you reasonable notice, and you can decline sometimes, but you have to accept his presence and the presence of other potential tenants at reasonable times.
If you don't have money for an attorney, contact Legal Aid. They will be able to give you the names and numbers of resources in your area. To me it sounds like your landlord thinks you don't know your rights, so he can intimidate you. There are plenty of organizations which can help you understand your rights and responsibilities as a tenant. |

The way I understand it, your landlord needs to tell you at least a day ahead of time that he needs to enter your apartment and the reason for the entry.
He can't just pop open the door anytime he wishes.
Some landlords don't know what the law is. Find out what the law is where you live and inform him of it the next time you see him.
If there is an emergency, like your hot water heater is leaking and causing damage or a gas leak or something that needs immediate attention when you are not home, I believe he has a right to enter under those circumstances.
The only reason he should enter is if there is maintainence to be done that you requested or that he informed you that he needed to do and then you should know ahead of time when he intends to enter and it should be a time that is agreeable to you.
There may be an allowance for a safety inspection to insure that his property is being taken care of and remains in good repair once a month or so. Even so, you need to know in advance when it is going to occur and have the right to be there at the time and know exactly for what and where he is going to look.
There are laws that you both are obliged to abide by. Let him know that you expect him to abide by them.
You have a right to feel safe and a right to privacy.

It depends on what state you live in..this site will tell you what the notice of entry is for your landlord and then you can tell him what it says. The range is reasonable notice to two days. So, it sounds like he is violating your rights and you need to find out your rights and make sure he knows you know them so he does not keep violating you. I had a similar situation and we called the police and filed a report for trespassing because he entered our rental with out our permission. |

Unless you are entering my apartment for a MAINTENANCE emergency, you are to give me a 24 hour notice of when entering.
If my apartment is entered again unannounced for non-emergency reasons, I will be calling the police for unlawful entry.
YES, landlords CAN be charged with unlawful entry for doing just what you described. There was a famous case that made the news a few months ago, where a woman set up a video camera while she was at work, to find the landlord entered her apartment while she was gone, tried on her underwear, etc.

Pervert Alert! Completely Illegal. If a landlord wants to get an inspection done for whatever reason he should have a written documentation given to you or by your door 2-3 days prior to inspection. If he shows up un announced that is an invasion of privacy. Set up your camcorder discreetly and record his unannounced presence, once you have that call a Lawyer and you have recorded evidence. that should let you live rent-free for a couple of years. |

There is a huge problem here. First of all, that's a huge no, no. Once you start paying the rent, that apartment is yours to live in, he's not supposed to walk into your apartment like he's walking into a 24 hour convenient store. It doesn't matter whether fixing the plumbing or heating, he's not supposed to walk in, period.
The solution to the problem is the following:
1. Replace the locks in the apartment. Call a locksmith and get the original locks replace with ones of your own. The reason, when you moved in, the landlord gave you a copy of the apartment keys, which means he has a spear set, and there lies the problem. He's walking into your apartment like he's walking into a 24 hour convenient store.
If you live in the city, go to the nearest hardware store and get a cylinder lock, a deadbolt lock (must preferred dead bolt lock is Mul-T-Lock Deadbolts), a door chain (if one is not attached to the door at the moment), and my personal favorite, a slide bolt (the one use to close gates and small garages).
If possible, have the locksmith come in on the weekend to install the items I've descripebed earlier. Make sure the landlord is not on the permisses, beacuse some landlords don't like to see a locksmith from another company replacing locks in tenant's apartments.
2. When ever you're home, lock, bolt and chain the door. Also, jam a chair up against the door. And for good major, close and lock the window at night or when not at home. This is useful for those who live in older buildings with fire escapes. If you still need to get a little bit of fresh air, open the windows that are accessable to the fire escape. Again, this is useful for those who live in older buildings.
3. Inform the landlord, that access to the apartment without your advanced knowlage is not permitted. Inform him that if he needs to get access to the apartment to notify you in advance so you are aware of it. And if he dose it again, without your advance knowlage, you call the cops on his, well you know. Also take is royal backside to court.
Sister, know your rights. In reality, under any circanstances, the landlord is not suppose to enter you apartment without your advance knowlage.

You should read your lease to be sure, but the law in most states says that if a landlord needs to enter your place for any reason then they should give you notice and your lease will usually state how much of a notice. In South Carolina I know that the standard lease says a 24 hour notice. If they come in again, call the police. You pay rent and therefore as long as you are paid up the place belongs to you, it is your home and you have an expectation of privacy. My grandparents rent a place to tenants and they are not allowed to enter for any reason without permission unless it is an emergency situation. |

If they must access your apartment they should knock and allow you time to respond and then if they have to walk in and announce them selves. I live in Minnesota you should check your local laws pertaining to this .

I had the same thing happen to me. Landlord lived downstairs. (That was my first mistake) He had decided to paint the hallway. Had painter come in - I came home and my apt door wide open so paint could dry & heat was up to 85! I complained. He paid the "the painter" so it "was his obligation to have the paint dry" UGH! - "No! MY bill!!"
#2 He "told" me that he was going to have Christmas dinner with all his family and needed to use my stove to heat all the fish because he didn't have enough room in his "house" to cook everything. I came home from work and found his son in my kitchen using the stove! FURIOUS?!?!?
Soon after that I called the local electric company to see if I was actually paying for their bill & mine, because it was too high for the little space that I had. (Had them come over when I knew "they" weren't going to be home) Come to find out, I was paying for both! Not to mention, he had heaters on the roof, so when the snow melted it dropped on top of my car and damaged the roof.
Wanted to sue, but he's an ex-police officer and knew all the kinks........UGH!!
In short - get to know your rights. Whether you rent, lease, buy, option to buy, etc., just know your rights, because you do have them - no matter what!
