tinkerbell_122302 | Can a landlord walk into your apartment, and can they charge a guest rent? |
my fiance lives in arkansas and his landlord wants to charge me rent for visiting him for my 2 weeks holidays and his landlord also walks into the appartment and into his locked room when ever they want too. is this legal in the state of arkansas? |

He can not enter the apartment, but can require you to sign the lease. Two weeks makes you a resident, not a guest. |

google "Arkansas law tenant" and read what it says.
then read the lease

the "usual" rules are no and no. landlords may inspect and/or enter, but only with advance notice unless it is an obvious emergency. short term guests should not cause a rent increase -- guests are a normal social occurrence. |

On entering the unit for a non-emergency situation, he will need to give reasonable notice to enter, next time the landlord pulls that one, call the police and file a trespassing charge against the landlord
on charging for a long term visitor, what does the lease say? if the lease address this issue then he will have to obey the lease, if the lease is silent then the landlord can not after the fact imposed restriction or penalties nor change the terms of the lease until it ends |

As far as I know it is not legal. Your landlord cannot enter without giving you notice. |

I wouldnt believe that would be legal in any state. Also, I do not believe that the landlord can charge a guest rent. Your boyfriend would only be breaking terms of the lease if he had someone in the apartment more than 30 days. |

How is he trying to charge you rent? Rent is a set amount of money that is agreed upon when the lease is signed. He cant just say oh you owe so much more money for you being there. That is illegal.
A landlord has to have a reason for coming into the apartment, to fix something that you requested be fixed or in case of an emergency (the apartment is on fire) other than that they have no right to be in your apartment. |

check you lease agreement. actually, i think they have to give you 24 hr notice before entering the apt but his leasae agreement may state something else. some lease agreements do state that guests can only stay for a certain # of days before being charged to stay there. mainly--just ck your lease, it should all be spelled out. if it isn't spelled out in the lease--then i don't think the landlord can charge you. |

Most states require landlords to provide 24-hour entry notice, but check your state's laws and the rental agreement.
Also, you say "locked room"? Is your fiance living in shared housing? If so, then your landlord may have free access to the apartment's common areas. Also, in shared housing it is reasonable for a housemate to pay additional for having a guest. |

Not in Arkansas or anywhere else.
You don't have a contractual obligation with him, so he can't charge you anything.
Landlord's need to realize that these stupid fees are not collectable in court. |
