Can a person put a lien on a house I've built that I didn't hire directly to do the job?
My husband hired this man (Mike) to put vinyl up on two of his houses. Mike subcontracted out the job to someone else (Joe) to do the job. My husband paid Mike for all of the work; however, Mike will not pay Joe, who did the job. Now, Joe, who did the work, says he's putting a lien on our houses until he gets paid, even though he knows we paid Mike for the job and that it is Mike that owes him. Can he really do this to us?

NO WAY...he didn't have any agreement or contract with you......He has to sue the jerk named Mike to get his money.

Yes. You should have requested a lien waiver from Mike before you paid him. A lien waiver is a legal representation that your contractor (Mike) has paid all of his subcontractors (if any). It protects you from situations such as this.......

Well, my mommy works in contracts, which she's been doing for a LONG time...AGES! She told me that if you have a contract with Mike then, unless there's a claus in there saying he can't sub it out, he can. You can put one in there saying that he can sub it out WITH permission but that's it. But I don't know if you actually have a contract or not. I've got a feeling you don't. Therefore Joe can put a lien on your house. :( Even if he knows that it's not you who is to blame! You should contact an attorney to see what to do about the lien. I hope everything gets settled!!!

Yes. It is called a mechanic's lien and you will not be able to sell or finance the houses until it is paid off. You have to go after Mike to either force him to pay Joe or to give you the money back so you can pay Joe. I suggest that you get an attorney involved now, before a lien gets filed.

yes, he can. As a sub-contractor, he gets paid from the money you put out to have the house built. YOU areresponsible to make sure they get paid

No. I don't think Joe can do that because you didn't have a contract with him. Joe was just a subcontractor. You had a contract with Mike and you paid Mike. You are clear. Joe's gripe is with Mike, not you. But he may realize that Mike isn't going to pay, so he's trying to go after you (hoping he'll be able to scare you into paying him). The truth be known, both Mike and Joe may be in on this together. It might be a scam. Mike gets money from you and then Joe gets money from you. They end up with twice the money the job should have cost. I would contact the authorities. The police, the Better Business Bureau, Government Offices that oversee the construction business. Also, the FTC (Federal Trade Commission) would be interested in hearing about your experience. You can find them on the internet. Do a Google search on FTC. Tell them your story. Also, if Joe is somehow successful in putting a lein on your property, (laws in your state allow it), he still can't hurt you until you try to sell your property. The lien would just sit there waiting for you to try to sell. So, you don't have to rush in your fight to keep this guy from trying to rip you off. You've got time. Something you might want to do (if you can find a lawyer who will work for pay only if he wins) is to get a lawyer to check Mike and Joe out to make sure the two of them haven't been doing the same thing with other customers. If the lawyers research show that the two are criminals, possibly they can get authorities to prevent or remove the lein. Most lawyers won't charge you to listen to your story (and determine whether they can help you). Lawyers who feel they can win will also work for you with the understanding that it won't cost you anything unless they win. They're out there. Check the yellow pages, or go to a lawyer for a free initial visit, and if he/she can help you, great. If not, ask if he/she knows some other lawyer(s) who might be interested in your case.

He can indeed, at least in my state. That's how liens work. That's why you have to really protect yourself when you have work done on your house. It's different in every state, so go to your state's web site and search for the rules. Your state's web site will tell you how to protect yourself in the future.

What's worse than all of this is that you could be liable for your contractor's social security taxes and workman's comp premiums.

While Mike and Joe are leaning on your house.

Get em some hammers and ask them to help build it. They are builders I think. Then buy em a really nice lunch, get em drunk, make em feel really guilty about whatever bad things they are trying to cook.

Find out what the real issues are.
