ASW | Can a prospective tenant ask for a landlord's credit report? |
I'm moving to a new location and since foreclosures are on the rise, I'm a little concerned about renting. Is it acceptable or legal for a prospective tenant to ask a prospective landlord about his/her credit? If the landlord forecloses, I'm the one getting the boot. I think I have the right to know. |

There would be no freakin' way I would let a tenant look at my credit report. It has all sorts of information that is none of their phucking business. (like how much the mortgage is, what do I own, my ssn, etc).
If I was asked this there is no way in hell I would even think about renting to this person. Too noisy and completely out of line.
It is legal to ask for a credit report, you can ASK anyone. Ask your boss, see how they react, your neighbors, your friends.
However, is it "acceptable"? No, not even close. You can ask me if I pay the mortgage and you can look up the court records to see if I am telling the truth, but there is no way a renter has any right to so much personal and sensitive information. |

You can ask but you will not get the information. I suggest you check with the clerk of court in the nearest Federal bankruptcy court. If you the landlord's name, you can find out if he filed for bankruptcy. Check county clerk of court for records of a foreclosure action. Not many landlords are having financial problems. |

As a landlord, if a prospective tenant ever asked that I would not rent to them. We are also in a time of lawsuits for no reason. Last thing I want is someone checking to see my credit so he can sue me as soon as he gets in the home. |

Not really, unless you are in a business that requires it such as a bank, or company that needs it to participate in their business. They can pull it themselves from www.annualcreditreport.com. A FREE reporting agency and you can look at it then if they let you or give it to you. The laws governing cbi's are strict and in depth. Your best bet is to go to your local courthouse records department and see who owns the property titles. Look at the lienholders and if there is more than one than that property is maxed out to the hilt. Also ask if you can see any open tax liens. Do a little homework and you can see if that house is the one you need to put your money into.

No you do NOT! You have no right to any of their information. and you do NOT automatically get kicked out if a place forecloses, that is up to the bank. I know people are scared right now, but you do have rights as renters. |

I can understand your concern. But there are only about a thousand other things that can happen to you when you rent a place - including signing a 6 month or a year lease only to be asked to leave with no more than a 30 day notice.
I am guessing it is legal, but I would not ask. This could cost you getting the place you are interested in and might offend the landlord. (How would you feel if this happended to you?)
If you are that worried about it, you might check your state laws concerning this subject. I am guessing that the bank probally has to give you at least a 30 day notice since you are renting. Do not quote me on this one - please check the state laws. |

Boy that would be turning the tables! I would be interested to know the answer on this one. It would only seem fair. Tenants do have rights too.
I have dealt with some shady landlords ( I didnt know it it til it was too late), but I had to give the credit info, references etc and somehow it doesnt seem fair if a tenant cant check out a prospective new landlord.

You can ask for anything, but he can refuse. Explain your reason, but I'd tell you to look elsewhere unless I was very desperate for a tenatn. |

ive had my current apt complex do a credit check on me before moving in... Before i came here i was going to rent a home thru an older couple and they wanted to run a credit check> i figure it is their property if they want to know how their tenants payment history etc is they have the right to know before they allow you on their property. |
