sunshine | Can a rental office verify that I receive child support? |
I am looking to move into a new apartment. I'm a single mother with two children, however, I only receive child support for one of them. All of the decent apartments are income restricted. When they include the child support it makes me over by literally $200.00...and they won't budge on the decision...they always tell me I make too much money. I think the whole thing is ridiculous. There are only a few places that do not have income restrictions...however, they are way out of my price range. I would not be able to afford them each month.
I recently found a very nice complex with nice townhomes. I filled out the application but indicated that I DID NOT receive child support. My work income, rental information, etc. is correct. I am waiting on their decision now as they have sent my information to their compliance office for approval. My question is will they be able to verify that I DO receive child support? How would they know? I know it's not the best thing to do as far as lying on the application but I'm struggling with two children. I can't afford the other apartments. And where I am now is income restricted, however, when I moved here I was within the their guidelines and now I'm not. |

If all you did was fill out the application and have not started the tax credit process (income restricted) then no they will not find out... YET, once you fill out the tenant questionnaire (the form with all the yes/no questions) it will ask you if you receive or are entitled to receive child support. Being you have dependents the question will come up regardless if you said nothing about it on the application. Result of "No" answer = You signing an affidavit stating you are entitled yet do not receive support for a specific reason i.e. safety reasons for you and/or children, or he is in the service... Result of "Yes" answer They will verify via internet or the 1-800 number, you must authorize them to verify as they gather the information using your social security number. Either way they will verify regardless of your answer, so just note they will verify only because you have dependents. I am assuming you are applying at a 50% or 60% median income property, if you only over-qualify by $200 you can qualify at a 70%, rents may be a little higher but not as much as a convictional property which is usually at market rate.
I would look into whoever is filling out your employment verification, do they include O.T. that you had a couple times but not on a consistent basis? I hate not giving hope but I do this everyday and if their is a loop hole I can always find it.
By the way... That "Lauren" person above has no clue what they are talking about. The income restrictions have not changed for 4 years! FOUR YEARS Lauren. They are not raised with inflation! I'm sorry to be so crass but if you are in the industry GET OUT! The income limits are based on the median income for that county regardless of what state you are in. This means they take everyones income in the county rich and poor, with that figure they get the average number. Also, you will never have to pay back rent, you would however have to move. The program in it's entirety is a failed system thus has been proven. Lauren you need some additional training if you are in the management field... if not, stick to your day job. |

Do you receive child support through your government/court agency, or does the child's father pay you in cash?
If your support is documented with a government agency, then its certainly verifiable. And its possible that they could do a background and/or records check as part of the application process.
Look at the application form that you signed - is there any fine print that states you are giving your consent to have your records verified?
In general, almost anything with a paper trail is verifiable, and therefore not wise to lie about. If you consent to a background check/verification of records, then its certainly possible that they could find out you lied.
(Not to mention, of course, that its not ethical to lie.)
Obviously, if the child's father pays you in cash and you don't go through the government/court, there's less of a chance that they'd ever find anything out. |

Since you are apparently looking only for subsidized housing (as a landlord I want my tenants to make as much as possible) and lying on the application could actually be federal fraud and include (most certainly) eviction, repayment of all benefits and possible criminal prosecution. |

If you are caught in a lie on your rental application you could be, evicted from the apartment for falsifying you application and 2) you could lose your govt benefits if the apartments notify the govt. And if they do find out they WILL notify the Govt. |

How do you receive your support payments? Is it through a county or state agency? If so then most rental communities that have income restrictions are going to check with these agency's to verify that you are not receiving services from them.
You might also want to consider the fact that most places have a clause stating that intentional misrepresentations on an application can be grounds for eviction. Check with your local housing council or social services agency for help finding a home for you and your children. |

You are committing fraud if you do this. They can, and will, come after you for back rent if you are discovered, and it will also disqualify you from any future subsidized apartments. You don't say if the $200 is an amount per month or per year that you are over, but if it is per year, I would cut back a couple of hours on work, show them a new pay stub, and then try again with revised pay numbers. Also, the income limits do change every year, usually increasing with inflation, so ask around at a couple of other places to see what the 2009 income limits will be. Finally, if you have extraordinarily high medical expenses, or pay large health insurance premiums, some apartment complexes take that into effect and "deduct" that from your income, which might give you the cushion you need.
Another option is to go back to family court and voluntarily request a deduction in child support from the father who is paying it to an amount that will legally qualify you for the apartment.
Option #2 is to get the second father to pay some support - take him to court and get a nicer place. |

I am almost certain that they cannot verify whether or not you get child support. You are doing what you need to do in order to support your kids...so don't feel badly about not including it as income. |
