Can a roommate sue me after I evict them for failure to pay and marijuana possession??
I recieved a call from my roommates boss that she was fired....I was a little bit concerned. When I called her...no answer, she never came by....close to the 1st....I still did not recieve anything, plus she was smoking marijuana in my apt...and I did not approve of that...so I posted a note explaining she has been evicted.... On July 3rd, she came into my apartment. While retrieving her things she damaged my door...and other property. I called the police and she has been charged with vandalism. The next day, while I should be having fun on the 4th of July...she is calling and harassing....claiming she was going to sue....which is nut...because she has not establish residence here..... Any help here???

I recieved a call from my roommates boss that she was fired.I was a little bit concerned due to him claiming she cause a disturbance at the workplace. When I called her, no answer, and never came by. Close to the 1st....I still did not recieve anything, plus she was smoking marijuana in my apt, which I didn't approve. So I posted a note explaining she has been evicted after the advice of my building manager and owner. On July 3rd, she came to the apartment. While retrieving her things she damaged my door...and other property. I called the police and she has been charged with vandalism. The next day, while I should be having fun on the 4th of July...she is calling and harassing....claiming she was going to sue....which is nuts...because she has not establish residence here..... Any help here??? She was not on the lease, I am the only one. She did not pay any bills, or deposit for the apartment. She has a bed left here, but I dont want her to get it w/o an PD escortn present.

With no agreement she isnt in a good place. What about "squaters rights"? Was she there more then 3-4 months? Im in NY so check on that. You might have been required to give her a lease, add her to the lease agreement in place or maybe you violated YOUR agreement. So make sure your landlord is on your side and doesnt allow your x roommate to slander your good rep with the rent office. She has a history of violence, confirmed by her now X boss and your charges against her. You need proof of payments for bills, checks, money orders, banks statements, just in case. So it shows YOU pay the bills. Make sure you have that ready. You should also get a restraining order that specifically says she can get her bed. You can throw the bed out, she has no receipt for it and no proof. So your ok. Worse case scenario, she proves you owe her $10 for the bed lol. Change your locks, put passwords on your cell, electric, cable, and all accounts she is aware of. Because she is the same sex and has your info she can wait until the weekend or when you have family and friends over and call ALL YOUR ACCOUNTS and turn them off. This includes car insurance and anything else you can think of. People can be cruel. Imagine no lights, no cable, no cell phone, no home phone, car insurance, etc etc all at one time. Also call the credit bureaus and put a fraud alert on it so that when anyone tries to run your credit they have to call you on your cell first before they authorize anything. That will stop anyone including her from getting a house, car, credit cards etc etc in your name. Just make sure you listen to me and put passwords on ALL YOUR ACCOUNTS IMMEDIATELY. She plotting right this minute and asking someone who is three times as evil on how to get you back. Even if she isnt crafty secure yourself. Dont forget your telephone at home too (password) and see if you can block her cell number, and any other number she used to call you from. Ask your residential service and your cell company can you do that and fax them the police reports you and her x boss filed. Thats right you should have a copy of that too. Alot to do BUT you should already have this done anyway. Take you last name off of your door and when leaving your outgoing voicemail use a mans voice your x roommate doesnt know for it. Make sure he says "WE ARE NOT HOME RIGHT NOW", yes "WE". Oh I forgot, so she dont steal your important mail go to paytrust.com and get all your bills forwarded to a po box and they will scan your bills and you can pay your bills with a click and that way you can also see your bills like they are in your hand online. No paper statements going to your house. No chance or anyone getting your information I know I know I love me too =) That concludes the "Shedding Stalkers For Dummies 101" and your welcome.

Your local and state laws will have a lot to say about eviction, but kicking someone out is not a legal eviction anywhere.

Your roomate is unlikely to sue, it is expensive and she's not likely to get an attorney to take this case on a percentage basis.

You may get into trouble if she goes to a tenants organization, they do help people for free, but if she was just a roomate this may be difficult to get help for.

I would honestly not worry about legal action, but if she has any large brothers, you might be in trouble.

If she was on the lease then she may have a slight chance but I wouldn't be worried. If she wasn't on the lease then she's out of luck. A stoner isn't going to pony up the cash for a lawyer.

I wouldn't worry, she's making threats.
Do you have anything in your lease that prohibits the use of drugs, most rental agreements or leases do. They have a forced eviction if drugs are used on the property. Use this if you have it or, just tell her your not going to press charges against her for drug use, all she has to do is forget you exist.

Maybe. It's none of your biz that she was fired. Her ex boss needs to be careful what he says about her. Also if you did not document her pot use by calling police, its your word against hers. A lot depends on whethier you have a rental agreement with her and what state you live in.

You can't evict someone if they are a roommate, you aren't the owner of the unit. Did you two have a written agreement? Eviction is a legal procedure and if her name is on the lease she has a legal right to the premises and the landlord will let her back in the unit if she is on the lease. You can't just arbitrarily try and do a self-help eviction.

Your immediate task is to change the lock to your room. Was there any lease agreement signed between you two? If yes, you'll need to read the eviction clause to ensure you're not against it. If no agreement has been signed, your ex-roommate has no grounds to sue you. Where possible, change your phone numbers to avoid any further harrassments.
