Can a tennant be evicted for bringing in 2 new pets that are not approved by the landloard.?
When tennant moved in the landloard approved those 2 dogs to live on the property. Since that time one dog has died and now the tennants have brought in 2 new dogs without the landloards knowledge or permission. Would this be grounds for eviction under California law?

yes. The landlord approved 2 specific pets. In the leases I prepare, those pets are actually in the lease by name. The landlord approved 2, not 3 dogs, anyway. The tenants are probably doing other things, too, if they didn't call the landlord and bring the dogs to him/her for approval. Landlords don't like breeds that could cause an insurance problem - dangerious breeds that may bite someone and cause a lawsuit. They also don't like sneaky people! If you are the tenant, fess up. If you are the landlord, use your discretion. Are they dangerous? What about an addiitonal pet deposit. Are these good tenants except for this one slip-up?

i dont know california laws but i think yes.As before renting you should of asked if you could of had pets then this would not been a problem for you today.

if there are more than allowed for on the lease, the lease has been breached

Absolutely ! In California the landlord has the advantage and can begin eviction proceedings for just about ANY reason.

It all depends on what the lease says. Read through the lease carefully and see what it says about having pets and you can either use it as your defense if it is in your favor. If it is not though, then you are in the wrong as the lease is a binding contract and the landloard can either force you to get rid of the dogs or get out.

I am not sure with the laws of California. However the landlord agreed for two dogs but not three. You need to look at the lease and see what it states about pets. Some places have one pet deposit for several animals at one times but they do have there limits. it also depends on the size of the animals . I would read the lease carefully cause the landlord will found out.

Yes.. if, as you stated, the contract states a total of two dogs andif he brings in three.. he is in breach of contract UNLESS the owner (landlord) agrees... What the tenant should have done to be legal is to have written to the landlord requesting such prior to his just bringing them in.. It is a minor point but at any rate, the tenant is in breach of contract.

Sure could. Contact your tenants association. And the management of the building. not the landlady, the management office.

Dogs are a nuisance in an apartment.

Absolutely! If you break your contract, that is grounds for eviction.
