My rent is $720 and in the column to write it out, I wrote by accident "Seven hundred and thirty dollars". Now my landlord says that I am late and has put an eviction notice on my door but the check was cashed!!
It was cashed for $720.
isn't this against the law? |

It is probably just a mistake. The property manager probably has a knee-jerk policy of instantly delivering an eviction notice at the slightest hint of trouble. As long as you are paid in full- and continue paying in full the property manager won't do anything.
Pursuing such an action is too expensive and time consuming and it generates ill will. No landlord would do this IF this is your first and only infraction. |

you paid your rent. you paid your rent on time. sue him after you move. the eviction won't go through if you have proof you paid. |

I would think so. If you were to go in front of a judge and he would see what this landlord is trying to pull I think it would make the judge mad counter sue for loss of work pain and suffering LOL . Are you sure this is the reason? |

Either way, you wouldn't want that jerk to be your landlord anymore. Defend yourself, of course, but I'd start making plans to get the heck out of Dodge. |

yes. they have to go through the court to evict you and if they cashed the check then they have no reason to evict you. and if they try to go to court its good you wrote a check because you have proof when it was written and cashed.. |

I would think that he would not have been able to cash it with the amount not right . Check says one thing and they gave another .
If anything your Landord should have noticed that and told you before he cashed it , and had you write another one .
I think anything over $1,000.00 would be a Felony , but not quite sure on that .
Regardless I dont think he should have evicted you for 1 check that could have been straightened out , done properly . |

If the landlord states that he's evicting you for the error you made on your check, then no, he cannot evict you as the check for the amount of rent has been negotiated. However, if you provided said check after the alloted time per your lease, that would be a reason as to why your landlord is claiming to have grounds for an eviction. Seems like there's more to it than the mistakenly written check. |

I think it is illegal as long as he has the money and he got it when he was supposed to. Call an attorney if this is something you want to fight. If I were you I would just move because your landlord seems like an ***. |

He cant get you for a bad check if it cleared. how did they decided which one was right 720 or 730? Did it clear bank in time? I would question it more. see a lawyer. if your rent is paid you have till end of mont anyhow. you can fight it in court. try online ask a lawyer sometimes there free advice. oh try tbo.com for channel 8 news and go to there lawyer link they like getting involved even if your outta area. |
