P M | Can an over-21 renter be evicted because of having alcohol? |
Okay...so some roommates and I rent a house together in Virginia. We're all adults and of age to drink. It turns out our landlord is a crazy old religious lady who thinks *any* alcohol is evil. She saw we had a 12 pack of beer in our fridge the last time she was over here and went nuts. Now she is demanding that we cannot drink in our house because it's "sinful" and she doesn't allow alcohol on our property.
Does she have any legal right to do this or to make this kind of demand? I'd never even thought of it because it's so bizarre, yet here it is. Any help? Additional Details Also - there's nothing in our lease explicitly saying no alcohol. She wants us to sign an agreement for no alcohol in the future. None of us have signed. Is it her right to demand we do? |

Practicality comes into play here. Of course the old dear doesn't have the right to do that, unless specifically stated in your original lease. She can ASK that you sign an addendum, but she cannot force you to do so, nor can she prevent alcohol on the premises.
However, if you wish to stay in the house past the end of the present lease, you MIGHT reconsider. She surely will not renew the lease if you do not bow to her demands. And she COULD make your lives totally miserable if you buck her requests.
How to get around it ? Don't keep the beer in the fridge. Store it in a locked closet or similar where she won't see it. OR just buy a cold 12-pack to drink when the urge strikes.

It depends on the conditions of your contract and local ordinances. If she has some sort of clause in the contract that says that she can void the contract at her discretion for any reason then she can. This is unless there is some housing ordinance that says that a landlord has to give you some sort of notice and cannot immediately throw you out. This may very well be the case. You should Lexis-Nexis your town/county ordinances. I do not know too much about state or federal jurisdiction on housing. |

She doesn't have a legal leg to stand on...however, I hope you signed a lease that is long term (like a year) b/c if you don't have one and you are month-to-month, she is not required under the law to renew the lease.
You don't have to sign any such agreement, and even if she did, it's not enforceable in a court of law.
She can't evict you b/c of it either.
PS: This falls under "lifestyle" and "lifestyle" portions of a lease contract are NOT legal in any state. Too many people who think they know real estate law, thinks that if it appears in a lease, and you sign it = legally enforceable.

No, she has no legal ground to stand on as far as I'm aware. Unless there's some bizarre clause in your lease she can't do anything. The only thing that a renter can't do is something illegal. If she walked in and you had a coffee table full of cocaine or something then, yeah, she could probably toss you all out. As you're all of legal drinking age and it's really none of her business anyway there's nothing she can do.
If she actually tosses you out I'd contact a lawyer. I'm sure some sort of housing discrimination law or other would cover it. At the very least you'd have a breech of contract suit that could be filed.

what is your contract read? if it staes in there acholol then she can if not you can do what you want to but she does not have to rent to you in one year or soemthign like that go to lawyer and find out for free what you can do. |

I dont know what the laws in VA are, but if you contracted not to do it, it is probably enforceable. Does your lease say that it is not allowed? |
