Can an owner legally do this?
Back in July '07 we expanded our business and moved into a building with a car wash and our coffeeshop in one corner of the building. We overpay for the small space we have and our lease is up this July. But the owner of the building comes in about 3 to 4 times a day and pretty much harasses the employees. If we pay our rent can the owner legally come in whenever he feels like without notice? I rent my house and I know the landlord can't come in without permission. Is it the same with a small business?

if it's really harrassment, call the police. but expect to find another place to rent.

If your business is a public one, and a coffee shop is, then he has the same legal rights to enter as anyone else does. You also have the same rights to call the police if he is out of control.

So often landlords think they are joint business owners but if your open to the public you can't really do anything unless he is actually harrassing your employess. I'd make him aware that i'm uncomfortable with whats going on then I would seek legal actions. This could be damaging to your business.

Unfortunately, since it's a public business (as opposed to your rented house being a private residence) he's allowed to come in there as often as the general public is allowed in (during business hours).

However, he is not allowed to harass, just as anyone in the general public isn't allowed to harass. It makes no matter how you know him, if he's harassing your employees, he's in the wrong. You can confront him about this, and if he refuses to change his ways, you can take legal action...talk to your local police officers or get a free consultation from a lawyer in your area (they're always offering free consults!).

Depends on the lease agreement I suppose. A small business is a lot different from a residence, since the business is open to the public and a residence is not. He's part of the public, so unless you can prove harrassment or the lease specifically forbids his entry I think you are out of luck.

As the business owner you can refuse to sell. He is the the property owner so a restraining order would not work. I would just professionally tell him if he is not there to buy something or talk business with the owner... please leave. I would also send him a certified letter asking that he not discuss business with the employess and that all concerns need to be directed to you in writing.

Often times they are not allowed to come in without notice, especially if it's a business! He could come in and steal something. He should be required to provide you atleast 48 hours notice before he drops by. Check your lease and be sure to look up renting laws in your state.

I really dont think they should be harassing anyone, especially your employees.

call you local attorney general, its in the blue pgs of the phone-book, they give out free advice for such things

my landlord at the last house i rented used to come in whenever he wanted and my neighbor would tell me about it. one time I caught him, i was there, my husband left took the car and he came in while he was gone.

i confronted him, he left, i called a cop afterward (should have called him while he was still there, i could have pressed charges) guess what the cop told me? 'well if he came in my house without my permission, i would have shot him!'

ok...I really never want to advise anyone do this and I'm sure it would be different in a business environment -vs-your personal home however, there are much of the same laws that apply.

call your local attorney general, the office is happy on advising....

Business rentals are different from residential rentals. Your business is open to the public, and your landlord happens to be a member of the public. If the employees are uncomfortable with the situation (or you are, as it seems), it's best to have a frank discussion with the landlord to see if you can resolve the situation.

correct me if i'm wrong, but isn't that a business? anyone can come in unless you have a sign that says you have the right to refuse service to anyone. but i think you are SOL on that one, it is not a home therefore you don't have the same privacy rights

As far as I know, if your rent is current and you are not otherwise violating the terms of your lease (subletting, for example), the property owner has no right to interfere with your business. In any event, he or she cannot simply show up at your place of business and harass your employees: the proper channel is through a court of law.

As laws vary from state to state, contact your local board of Realtors. They'll have knowledgeable commercial property professionals who will be happy to advise you, if only in the hope that you might avail yourself of their services in future.

Look, this a lawyer can answer, and its a pretty serious matter. He has no reason to be there unless you give him permission to be there. If you pay his rent, he should not be bothering you.

Since it is a business, he can come in as often as he would like. It is a public place, so he shares the same rights with the public. However, if he is harassing and taunting your employees, you should instruct them to call the cops. Especially if he is belligerent. His actions could be bad for your business. Write him a letter-keep a copy-and ask him to call or write you in the future if he needs you. Ask him not interrupt your place of business. A situation like this is private, and between the tenant and the landlord. Not the tenants employees!

Start looking for a new place to rent ASAP! You might want or have to do that once your lease is up.
