I live alone and my cousin used my home as their mailing address, she doesn't live here, but they have just gone through my mail asking who she was?
Isn't it unlawful, even for an apartment complex to go through someones mail? |

It is only an offense if they open the mail.
However, they can tell the post office that she does not live there, she should not be using an address where she does not reside.
You need to either fix this with your cousin or put your cousin on the lease. She is illegally using the apartments property. |

if the landlord did not OPEN the mail, then IT IS legal. It is the landlord's property, and they have authority to distribute mail to whomever it is addressed to living on thier property, as long as the mail has not been opened. When mail for someone comes to the apartment, that is not your name, the landlord does not know if the tenant has had someone move in with them, without telling the landlord.
But i tell you any legal actions you might try to take will only leave you apartment-less. sry |

It depends on where they saw it. If it was inside your locked mailbox, then they were probably in violation of some kind of federal law by doing so. But if they just saw the mail lying out on the table or happened to randomly be there when the mail carrier was distributing the mail, then they did nothing illegal.
See this from their point of view. They think they're renting one of their apartments to one person. Suddenly it comes to their attention that two different people are receiving mail there. It's in their best interest to check into the situation and figure out whether their tenant is lying to them or not.
(It's even possible that the mail carrier saw the mail with your cousin's name on it and asked the landlord if that person lived at your address. They might just have been trying to be helpful.) |

They cannot read the mail. As far as looking at it, I don't know for sure. Do you have one mailbox for the address, where you and your landlord get the mail? If so, they will always get to see it. However, it is illegal for them to open it and read it. |

It is only a federal offense if they opened and read her mail. The post man could have asked the rental office what apartment she belongs to if he did not recognize her name. I have had mail carriers come into my office and ask if people are registered to certain apartments before they make a delivery so that they can update things on their end. |

They have a right to only provide services to their residents. They are not going through the mail unless they open the envelopes. Sorry but you are in the wrong in accepting your cousins mail at your apartment unless she is added to the lease. |

Yes, it is illegal. They should not have any access to your mail at all. If it is locked, they shouldn't even have an extra key. I've had an apt complex do that to me before. They are just nosey and are probably trying to get more money if someone else does live there. |

It is VERY unlawful in fact it's a felony. You are paying for that mailbox and the privacy that comes with.
Ask them why they did it. And threaten to press formal charges if it doesn't stop. They know they can't do that. |
