If you can find a clause in your contract that allows you to, yes. I suggest hiring a real estate attorney, ASAP, if you plan to do this. Otherwise, you are taking a risk.
Unless the seller is a saint, you will lose your earnest money. Their is also "suit for specific performance" where the seller can sue you to continue with the sale or pay the sales price. |

Usually not. The only ways they can are (I think):
- Misrepresentation - If the buyer discover the seller made a misrepresentation about the propery, eg something important on the property information form, whether or not it comes with vacant possession etc, then if the buyer can show what the seller said was a factor in them buying the house they can walk away.
- Rescission following notice to complete - if the buyer can't comply with the completion date, then the seller can "rescind" the contract, cancel the sale, and keep the deposit. This isn't all that common as this sort of situation when it does arise tends to be resolved amicably.
But generally, the answer's no. If a party gets cold feet after exchange of contracts it's tough luck. As well as the action above, the buyer can can charge the seller interest, and even obtain an order from a court ordering the seller to sell. The reverse applies too, the seller can obtain a court order forcing the buyer to buy the property - if the buyer hasn't got the money however then the seller's more likely to just cancel the contract and keep the deposit. |

The buyer will lose the deposit (usually 10% of the purchase price) and possibly be sued for additional aborted fees by the vendor.
The vendor can be sued for inconvenience/aborted fees.
Once contracts are exchanged the buyer has more to lose. |
