Can he take me to court?
I rented from my father and did not sign anything like a lease or something.
And now I have moved out and I did not pay him for a while, I only paid the electricity bill. I did not pay him because the condition of the house was disgusting. It is like a mother daughter house and the side I lived on did not have running water or heat so I had to take showers on the other side.
Now he is threatening taking me to court to get him money.
How can he do that if I didnt sign anything with any terms?

Also, someone I know, owes his grandmother money and all he signed was a letter saying that he would pay it off eventually. There was no terms of when he would start paying it back or when it should be paid off.
She cant take him to court right?

in addition to not having heat and water, the ceiling in the entrance room caved down and there is no insulation and basically no roof.

if he does take you to court, you should get proof about the water and heat...as a landlord he is responsible for having that fixed for you...as far as not having a written agreement it sounds like you will come out on top but I would talk to a lawyer to be sure. As for your friend, he might have a problem. If he signed something saying he would pay her back, then a judge may demand payment to her and soon. Good luck.

The situation with you and your father is a 50-50 chance. Your dad could win because there is a type of contract called an "implied contract" this means it is created by the actions of 2 parties - you moved in, so typically that implies you are going to pay rent or a mortgage. This does not have to be in writing or even oral, it is completely created by actions. But then again your dad neglected to fix basic necessities, so that makes him a slumlord and depending on the judge it could go in your favor. I have a question for you though-if it was so disgusting why did you move in? As far as grandma goes, she will win especially if it was in writing. The courts definitely will look at it as though this young man took advantage of an elderly person-it happens all the time. tell that man he should be ashamed of himself for taking advantage of his own grandmother-that is a crime and he should be punished.

dad probally doesn't stand much chance in court but . . .Granny has a signed document with no terms thats up to the judge. . been in the same situation with my husband and his grandma and he had to pay her the 2500.00 immediately as ordered by the judge. Grandma didn't like me so if he didn't marry me then she told him he didn't have to pay so after the wedding she had him served . . . he lost and I paid her with a personal check . . .I also return her wedding gift to her. we don' t have anything to do with her after 18 yrs.

What you should have done was call the housing inspector and had him issued citations for the violations. The exact procedure varies from place to place, but you probably could have received a rent abatement for the conditions. Since you did not follow proper procedures, I doubt you will be getting an abatement unless you have a stack of proof (photos, letters requesting repairs be made, etc).

If the place did not even have running water, it may have been illegal for him to rent it out. You should look into that.

Not signing a lease does not excuse you from paying rent.

If he has proof you paid him even one months rent, that will be considered the accepted rental amount. If it was an illegal rental, you won't have to pay him anything more but you won't get the money you already paid him back.

on the first part he can but take u to court because it was a verbal agreement and depending on what the deal was and the condition of the house he can get all of the money. if it was nasty and dirty (take pictures and use that as evidence but your kinda in a hole if you didnt take pictures when you moved in) and if you couldn't take shower then he probraly won't get the money.

the second part his grandma can take him to court but she won't get anything because the verbal agreement said that he would pay it back when he could so he can pay it when he's able to.

Yes, you have to pay. You would have had to pay into a court-appointed escrow account to properly force him to do repairs. You did have terms, you just had an oral lease instead of written.

If there wasnt anyhitng signed, then all both parties have is their word and anything to back it up. The only proof he could have is your acknowledgement of verbal terms and / or proof of previous payments (example: checks or money orders) Your defense can be a list of all the problems that made the house "unlivable". Along with any proof you may have. You may take witnesses that seen the house's conditions. If you happen to of taken pictures that would be great and that would make your case. If it does come to where he takes you to court, you do your best to prove the house was unlivable.

I I were on a jury, I would give you and your friend the death sentence for taking advantage of your father and his grandmother. Both of you should be shot.

The house was fine enough for you to live there, regardless of where you had to take a shower. If it was that disgusting you would not have moved in.

I hope he does take you to court.
