Can i Kick my friend out even tho hes only 17??
This kid was kickd out of his parents house and i let him stay in my 1 room STUDIO bc i new wat it was like to have no where to go, well i sick of him being here, hes not on the lease and hes only been here a month or so, can i kick him out, or should i just have my landlord make him leave, and im not to sub out the room, but the landlord turned the other cheek and he says that he can take me to court for kicking him out with out a notice is that aloud?

Not in California. Once anyone establishes residency, you have to go through the eviction process to get them out. I wish all the above answers were correct, but not in this state.


Lets get some shoes
if he pays rent you have to evict him. doesn't matter if he's on the lease or not, you have to give him notice. if he doesn't pay, you can kick him out with no notice.

You need to research the month-to-month tenancy laws in your state. He is a month-to-month tenant. In Florida, he is only required a weeks notice to vacate before you start the eviction process.

I'm not sure you can just kick him out, I think legally your obligated to give some one 30 days notice. Questoin? Does he pay rent? If not what is he going to take you to court for? It would probably cost him more to file a cival case than he would get in return if it did actually go that far. My advise is, since he is a friend give him 30 days and tell them after that he needs to leave or you will be forced to make him leave. I would put this in writing you have "written" proof of the notice and try to get him to sign it. If he refuses to sign it, just make note that he refused to sign it and one what date and time it was.

Tell him that it's been long enough, and you need your space. Ask him to start looking someplace else to stay, because you don't have the money to support him living there. If he doesn't take you seriously, tell him to beat it.

A 17 year old is not going to take you to court. Court costs money, and he probably can't even afford the rent.

You have no obligation to take care of someone who isn't your dependent.

No, guests can't claim that they are residents of your apartment after a month, and this guy could take you to court for anything he wants to but the judge would throw the case out and probably give him a lecture. He is just trying to scare you into letting him stay there and he sounds like a real bum.

The longer you allow him to stay there, the stronger case he has for claiming that he is a permanent resident rather than a visitor. So if you want to get him out, I suggest sooner rather than later, and if he is that aggressive you might need to ask the police to be present while he moves. The reason is that he can easily call the police and claim that most of your things actually belong to him and that you stole them and locked him out. I have seen it happen. So take action sooner rather than later, and good luck.

If you have no contract either written or verbal then YES you can you pay the rent its your house
what did you agree when you took him in???
if you told him he could stay a long time then that could be regarded as a verbal contract
but as he is 17 & homeless i wouldnt worry too much if he dont have money to pay rent he is not gonna have the money to sue you
tell him hes a pain & that you want him out by the end of the week/month???
but remember hes only 17 so do it gently he may be very emotinally fraglie
but if ya want him out OUT he goes

Don't dump your crap on the landlord. Be an adult and take of your own mess.

You have an obligation to evict a tenant, even if you illegally "rented" to them. The landlord can and should evict you for violating the lease.

ha ha ha.......that is so funny...
surprised he didn't threaten to phone "welfare/child protection"for "abuse" oh yea they would put him in a "foster home" with "rules"

it's a scam to frighten you........
it's why the parents kicked him out..he was holding them "hostage" as well.......and knew you would take him in..
it's warm outside....he can move into a "cardboard box"

the landlord isn't involved........and be thankful the landlord didn't increase the rent having 2 people in that place.......

dump the kid...........you owe him nothing..
he'll probably go home.......where he belongs..

he has 2 parents and you should not have let him in ....

or gotten involved..
some kid knocks on my door....i send them back home and do not get involved in "family fights"..........
families have rules..and for a reason........
kid should be in school..getting a high school diploma..so he can hold down a job in the future................(you have said "him" so assume it is )
kid should join the military...and get some discipline...and rules....

not sure - but if you give him 2 weeks notice that should do. he has no contract. you are not his parents or gaurdian - I assume he is not paying for the room etc. he chose to leave home. he can try to take you to court but he would loose.

He's a minor! You do not have legal gaurdianship, right? You are not responsible for him legally? Call the police and Report him as a runaway. He is a minor.
