Can i be denied on an apartment because of my income?
My fiancee and i tried to rent an 2 bedroom apartment for 850 with heat and hot water included. We only pay electric. We make 2500 between us. My income goes up according to rent price. She said we would have to make 5,000 a month to rent. Is that fair? We also have 2 young kids and are african-american. She is caucasion.

While she is allowed to deny an apartment based upon a sufficient income level, this is ludicrous. She wants $60,000 a year income for a less than $1,000 a month unit ?

I smell blatant discrimination here. If you know some fine Caucasians, have them apply at her place and see what THEY are told. If the required income is less than $60,000 a year, you have a very solid case against her for racial discrimination.

Don't let that beast off the hook easily.

A lot of apartments have certain income requirements and it is perfectly legal. Typically though the requirement is 3 times the amount of rent so with making only 2500 between the two of you you are 50.00 short of that. (850x3=2550)

yea that is fair. im caucasian and my boyfriend is too i have excellent credit and don't make as much. He has terrible credit but makes a crap load of money. We couldn't get the apartment because they wouldn't take his credit and i didn't make as much. It can happen to anyone. Its just life!

6 times rent is a little higher than I've seen, but as long as they hold everybody to the same standards, it's fair.

Of course, they can. For a rent of $850 with two working tenants I would probably require sustained, verifiable gross income of about $3400 and/or qualifying co-signers.

What does your color have to do with it? $5000 seems quite high, but if the market is tight and this is the standard she uses for everyone you have no gripe.

Raising the income requirement for all applicants is one way to get the number down to a manageable level. There are many others if there are too many to deal with. Another is to forbid smokers and/or pets.

Yes- that is perfectly legal as long as they have the same standards for every one. It would only be illegal if she is telling just you that because of discrimination issues. But that would be very hard to prove. You would need to know who else they told that to.

Every place has an income requirement. Requiring $5,000 is a bit high, but not illegal. It is usually 3 times the rent. If they were using that standard, you still would not qualify.

The size of your family is completely immaterial. That # of people is fine for a 2 bed.

Yes. You can be denied an apartment because of your income.

Is that fair? It's fair to approve or deny a lease application based on income. Or on credit rating. Or on a whole bunch of other factors. It's also legal.

It's not legal to deny an apartment based on race...or on religion, or national origin, or a number of other factors.

Yes, you can be denied a contract for housing for any legal reason, i.e., one that does not illegally discriminate (such as based upon religion). It is very common for landlords to deny a rental agreement to anyone they feel is a possible credit risk. However, because it is so prevalent, it is also a way to hide illegal discrimination (such as race, or children, marital status, religion). Depending upon what protections your state laws give you, there may be a claim for discrimination, and there may be an agency that will hear your complaint and then force the landlord to come up with a lawful reason for not renting to you.

For example, if a white childless couple with the same (or less) income were to apply and be accepted to the same agreement, that would be evidence that the income was a smoke-screen for an illegal discrimination.

assuming that you expained to her that your income will increase according to rent, perhaps she just needs proof of this.

upon receiving proof of this she still denies you rental and cannot come up with another good reason as to why you cannot rent, then i think i would be taking my hind-end to talk to a lawyer!!
