i had dealt with a realtor on 2 sells and one buy of a home, we just inherited a home and wanted to sell it, we contacted our old realtor, she had her husband give us the contract, my husband was in ca to deal with it, he did not realize he was not dealing with our relto but her husband, he thought the agreement was 90 days, when he brought home the contract it was for 12 months, the reltor listed the house for our bottom line price, so we have been getting lower than that offers, my husband had a small stroke so i took the house off the market, does that get us out of the 12 month contract if so when can i get a new realtor to put it back on the market, we need to do some work on it but should be ready in 60 days |

Depends on the terms of the contract. A real estate lawyer would be better equipped to answer this. I'm sure you could finaggle your way out though. If the listing isn't exclusive you could talk with another realtor about listing it, and if they sell it at the price you want they get the commission. You can always market it yourself as well. Go around the guy. |

Tell your agent to take it off the market. If he objects, let him know you will make a complaint to his broker. That should solve your problem. If not, take it to the Dept of Real Estate.

I wonder if selling it yourself could help? I don't know if it would get you out of it? I would go that way if you can. Also, sorry about your husband, my mom had one in October. I've never been through anything harder.
Here is my FSBO experience if they tell you that you can get you out of contract. We found that www.forsalebyowner.com and Help-U-Sell have tools to help answer questions. We used forsalebyowner. We even called some of the owners in our area and talked with them. Most were very friendly and pro FSBO after going through both experiences. With the internet it was easy for us to go through the process without a real estate agent.
My husband and I have saved a lot of money staying out of the buying and selling at the right times, even when the media was putting a sunny look on the downfall. We have been looking at a site by a guy named Patrick, it may be "Patrick.net," I'm not sure, you can find it pretty easy. It will help you with the above questions and more. He has a lot of RAW information and numbers.
What everyone forgets is the real estate companies have a lot to gain by keeping us in the dark, and a LOT of money to buy off the media. I would research the Patrick site, before I make a move. The nice thing is he has the REAL AND BARE statistics and graphs, without all the interpretation from the media and real estate agents. The bare truth helped us make our decisions.
It's a crusade of mine to see no one else be taken like my siblings did. Independent research is key. Never trust someone that has thousands to gain. That most often means lenders and real estate associations. You will be surprised how easy it is to do it yourself and the savings are amazing. We landscaped and put in a new kitchen on what we saved selling it ourselves. I'm for driving the Mercedes myself, not helping a real estate agent pay for one. If you are not one for contracts and doing it yourself and live in California I know the one real estate agent who I do trust, and you can write me for her name. Good luck! |

Just call the Agent and tell them you have changed your mind. If they start asking questions then let them know you are not happy with the service you are receiving. But I must say they must be doing something right if you are getting showings and offers. The offers may not be what you are wanting but most buyers now days will give a low ball offer. You must have been happy with the Realtor in the past to call her again. Tell her to drop the home off of MLS and no more showings. Finish your repairs then have her put it back on the market at the price you want. You trusted her several times in the past. I believe it may just be a communication problem. The MEN didn't listen to what the Women told them to do :) |

This is not a good selling time for houses so keep it off the market and rent it after repairs. Next year would be a better time to sell. Very few can get a house sold today and the banks are foreclosing on the loans. |

First off just tell the Realtor that you want the price raised. Tell him he made a mistake. Then keep calling him every day about some stupid thing. If you get low ball offers just counter with a higher price. Keep calling and annoying your Realtor. Don't be rude or demanding, just be really clueless, tell him you don't understand. In the middle of an explanation cut him off and tell him someone else is calling and you have to call him back.. Call him back a minute later and ask him to start again. Ask the same questions 3 days in a row , just act like a complete fool. In a few days he will be happy to break the contract. Even if it doesn't work it will be fun as hell and will be a great way to blow off stress. I hope your husband gets better real soon. Good luck. |

The previous realtor can ask for commission if someone buys the house that originally saw it through your old realtor. OR, if your old realtor can prove the person who buys it was orriginally exposed to the property by him.

If you signed a real estate agency contract that was not fully explained, you have excellent grounds to cancel that contract. Basic contract law requires that all parties understand the negotiation. It sounds like this agent put his interests above yours with a 12-month listing. Typical listings are only 1 to 3 months. |

if the house isn't off the MLS and the lock box removed, your house is STILL on the market.
Why didn't your husband read the contract before signing? I can't believe you didn't even check to see if the listing price was correct on the contract.
Read your contract...most of the time it states that you can terminate the contract and you don't owe the listing agent a commission IF you sign a NEW listing agreement with another Realtor, and that allows you to relist the property. |
