So basically you are selling him the house? Mind your own business and stop being a control freak. Or next time don't mix business with family. If you are going to be keeping the house then you have a right to be upset about damage, but if it's just messy, you don't really have a say.

Sounds like they are destroying the property. I hope you have some sort of written agreement and that this destruction is specified as a grounds for terminating the contract. Garbage and trash everywhere is a fire hazard. You need to get rid of these people as fast as possible, or else accelerate the sale, get your money and run.

Dealing with family can be difficult. If they are renting with the option to buy, I hope a good contract was drawn up by a lawyer. Keep in mind that they are "Renting" and that in the contract you may have made known that periodic inspections may acure. They must realize that although they have the intentions to rent/buy this house, they must still abide by the rules you set in your renter contract. If you have given them notice on repeated violations, I would think you would be able to remove them, owing them nothing as the money they have paid is satisfying the rent.

I hate renters. What they cant break they **** on. Unfortunalty the law is always for the tenants stupid bastards. I have some renters I can't get out of my house and I am going to change the locks come the first of the month, regardless what the law says! I am sick of loser tenants!

that is if they owned it now. YOU are concerned, I am guessing, about possible repair costs
if they move out prior to buying it and getting
you paid off.

Since you most positively have a right
to protect yourself from possible damages
that might be greater than their
deposits, you can require them to
pay for a contractor re the wall IMMEDIATELY
[and a licensed contractor, not billy bob.]

they can trash and tear it up AFTER they
are the only owners--but not till then.

review your contract. IF there is nothing
in the contract regarding damage,
pray they fail to make a payment so you
can boot them out.

also, since I am fairly sure you contract
with them does require such, you should
be covered.

Also, last but not least, if nothing exists in
writing NOW to cover you, quickly buy
insurance to cover repairs.

U can at least buy that cause you have
an EQUITABLlE interest in the house.

and your niece(?) had every right to be angry.....
Does anyone from your mortgage company come to inspect your place?

I could definitely see your point if there was structual damage to the home in which case they should have to repair, or be sued/ evicted.... but to demand that they clean the INSIDE of the house is OUTSIDE of the scope of your 'landlordship'.



I am very sorry to hear that your nephew lives with a slob but he is a big boy now so stay out of the way and let him handle his business...
No matter how clean you THINK you are, there are quite a few people who could come to your home and give YOU the white glove test and you would most certainly fail!

If one of those white gloved people came from your mortgage company you would be SCREAMING for a lawyer to come to your aid.......

Now with all this said, if the home is a health hazard (which I dou bt, the board of health might have an interest if there is SERIOUS filth....but if you call them, it is certain that your relationship with your nephew and his wife will END completely and you wont have to worry about throwing them out since you will have ruined a marriage.

You would be an unwanted house guest....so ask yourself is a relationship with your nephew worth FORCING the home be cleaned to your standards?

I hate to break it to you but there isn't much you can do unless it is a provision in the sales contract. I can only assume you required a sizable down payment/deposit. That deposit is for precisely this reason - you are fighting a losing battle if you think that by getting them to tidy up once, they will continue to do so. It is not worth making a fuss or fight over - they will always be dirty. I suggest letting it go knowing you have that deposit to rely on if they should not follow through on the entire purchase. If they are paying you on time and all of the money you dont have any right to tell them to clean their home however if they are destroying the home then you hav eth right to have them pay for damages but for cleaning up. stay out of their business no matter how disgusting you think it is

You can ask your attorney to make sure, but if there is no contract, you can kick them out anytime. If you have a contract or lease with them, and can prove they are de-valueing your property, you might be able to kick them out.

I think the lines of landlord and tenant are a bit blurred since they are family. Treat them like any other tenant. For the moment, unless they call you to the house for maintenance issues, you needn't discuss business.

If they've committed to owning the house, the problem is out of your hands - they'll own the mess they live in. Otherwise, the deposit you hopefully secured at the beginning of their tenancy will cover any needed repairs.

Check your paperwork for a clause that might address "condition of property". If he is allowing it to become damaged without repairing it, you would have grounds to take some action as they are not maintaining it in the condition in which you went into this agreement.

Also letting garbage pile up is just asking for a rodent &/or insect infestation & guess who they going to yap to about having it treated? It is also a health issue. This certainly will also affect any appraisal value when the time comes to complete the sale if they are getting financing.

Is this nephew's wife some sort of domestic diva that merely lounges on the couch all day shoving chips & diet soda down her gullet while watching Oprah & Dr. Phil??? If she is not employed outside the home, yes, she certainly does have time to clean some things up & not just add to the problem.

If it's all verbal, give them the boot. Your property is only going to decrease in value if left at it's present deteriorating condition.

You might have some Jerry Springer material here...

If, in the terms of the agreement, you stipulated the home must be maintained and the terms of the contract are not being upheld, the contract has been breached and you may be able to get it voided. Can you prove you will in some way be financially damaged from the lack of maintenance?

It all boils down to what was written into the contract, and what would void it.

My good friend is renting my townhouse. Her two grown children are living with her and are total slobs. The bathroom is especially FILTHY. I have expressed how disappointed I am with their disrespect of my home, but to no avail. Now I see there is not much I can do about this as nothing is in the lease about this matter. I just wish I could let it go and not continue to be upset. Oh, me!
