Can i refuse to take work home with me?
if i work a 30hour week7.00am-13.00pm (contracted) can work get me to be on standby (this means taking a mobile home and work from home)from 6-11pm this means 11hours and then i still have to go to work in the morning and on my two days off i will still have to have the mobile as they want us to be on stand by for a week.
i really don't want to do this!!!!!!!!!!!!!!! i think work should stay in the work place and home is a place to relax and forget about work.

Sure...you can refuse. No one can "make" you do anything.

Of course, you also have to live with the consequences of your decision.

Possible consequences:

1) Your employer could decide to replace you with someone who is willing to do "standby" work. And then you will be out of a job entirely.

2) Your employer may allow you to keep your job, but your professional reputation will be damaged. Perhaps your employer will think of you as uncooperative or not a "team player," and when it comes time to lay people off...who do you think they will choose?

3) Your employer may be less willing to do favors for you (ex - give you days off when you need them, etc.) if you aren't willing to do what they want.

4) You may damage any potential for advancement you have with the company.

So sure...you can refuse to take work home with you. But you may want to seriously think about what that means in this economy. With so many unemployed folks who would do anything to have a job at all, it would be wise for you to pick and choose your battles. Otherwise, there would be plenty of people lined up to take your place.

Just a few things to think about.

Hi in uk, you sign a contract of employment, and if in this contract there is nothing about working from home or carrying a mobile, then they can not force you to do so. Depending on the type of work you do
it may be worth your while negotiating a further increase in hourly rate to do it.
But as you say, most people want a break from work, and to take work home , believe me creeps into your home life.
Say no, if they start to be difficult at work, keep an account of it and you may find you have grounds for complaint.
I had the work mobile one Xmas for 2 days, didn't turn it on once, and told work I was away and no coverage !!!! they could not prove it.

You can argue your point, but you probably won't get far...I have a mobile I don't want...luckily I never get call's out of hours

no they can't make you, you are contracted to work 30 hours per week, this is what YOU agreed to do, if they want you to work over time then they have to pay you accordingly and it's up to you what overtime you do.
They can't give you the sack if you refuse to work these times, if they did try and sack you, they would come off worse through a tribunal.

Beside you have a life of your own, what if you have a family to take care of, or other commitments or hobbies.
I agree with you work should stay IN work unless the contract says otherwise.

Only if its in your contract.
If its a big firm refuse. If its momas little bakery and you feel that they could go under without the phone aspect and you enjoy the job accept.

The answer is its up to you, if its not in a contract!!

I decided to leave corporate America only to find that being self employed gave me freedom but, also required more time because I was in charge all of the time.

My rule of thumb is: If you don't like what you are doing, the way you are doing it, and who you are doing it with or, for,YOU MAKE THE CHANGE DON'T LET THE CHANGE HAPPEN TOO YOU. That's really the only part that you have control over.

A better work experience is your decision. A better life is your decision. A better relationship is your decision. Look at what your career goals are. Go back too school if necessary.

Only if you're contracted to do what is effectively, overtime. If you work your hours and they expect you to work extra hours when you leave by being on standby, then they have to pay you for these hours and cannot expect you to work for no pay.

So YES you can refuse to take work home with you

If this was not part of your original contract then I say argue the point and leave the phone at work. However, if you're with an agency and this was not part of your duties when they sent you on this job then argue the point with your agency and ask for a raise. Added work means more money!!! Or let the agency be your voice and demand that you do not work stand-by.

In most jobs you get fired if you do not comply with company standards or demands. They typically tell you that if you don't like it to get another job.
