Can i sue my landlord?
Since i've lived in this house(over a year)there has always been a problem with the heating. I wanted to have British gas come out and send him the bill but he said no and got these gas people whom he knows. I've had several gas people come and they cant seem to find whats wrong with it,which made me wonder if their genuine gas people,it is now freezing in my house and the heating still isnt sorted,the gas men came out and said it was the sensors,they are saying now something else is wrong with it and have to wait for the part so have to come back another time!I phoned my landlord and asked him what he was playing at and that i havent lived in the house these last few weeks because it's too cold,he said if i didnt like it i could get out and he'll move his daughter in,how dare he threaten me,i pay alot of rent that i cant afford and he cant be bothered to do my heating?i also have waited all night in the past for these gas men to come out and they didnt show up!can i sue him?

I think your landlord is trying to work it out but maybe that isnt a problem that easy to solve and may take a while to fix it.

Ask your landlord to provide temporary heating (something like space heater) before he gets that gas fixed.

I don't know why you have to live in this house that long if you knows this problem been there forever.

Sure you can sue your landlord, but do you know how much it cost to hire a lawyer?

Well you cant really sue him in the way I think you mean. He should have carried out repairs such as this in a reasonable timescale. If he hasnt you may have a case to get the work done yourself and re-charge him for it. Only if he doesn't pay can you sue him for your financial losses. Not inconvenience or anything else just your financial loss.

However if you have had to move out due to his breach and suffered financial loss as a result you may be able to sue him for that financial loss - again not inconvenience or anything else.

Only if you suffered ill health or something as a result of his negligence could you have a further claim against him. In an English court you would have to prove he had a duty of care towards you and you suffered injury or ill health because he failed in his duty of care towards you.

Don't bother is my advice! Just keep putting pressure on him to get it sorted. Your only other course of action really is through Environmental Health. Every Council is duty bound to have a housing officer usually based in Environmental health. They will give advice and have the powers to make him sort it out.

In most states a landlord must provide a working furnace during the winter months. If repairs are needed and can't be made in 24 hours, your landlord can be responsible for your hotel bill where you'll stay until he provides you with heat.

it's generally understood that you can sue anyone you want, and for any reason (the US government is the exception: you can't sue them without their permission).

whether or not the suit is adjudicated depends on whether or not there are frivolity laws and whatnot, some other laws that make it illegal to sue someone for the particular reason, at which point a judge dismisses the case.

as far as your situation goes, much of it depends on your lease/rental agreement (if any), and landlord-tenant relations laws enacted by parliament. i would check with a solicitor on the specifics.

these days, living anywhere that ambient heat does not exist year-round is a bit of a pain in the neck. it also causes rents to skyrocket. then you have governments which provide heating assistance, increasing the [already crushing] tax burden, thus creating an endless cycle of barely living paycheck to paycheck, and not well at that.

i would advise anybody making less than $100k/year to move to a warmer climate (and abandon any countries that don't have warm climates). yeah, infrastructure in cold climates would fall apart without working poor to do dirtywork for the rich, but hey, screw em!

Um, so why haven't you moved out? Don't get sue happy. Just leave. This would be a good reason to break the lease without repercussions.

what is going with your landlord. whats he doing that you want to sue him for. what did you, did you mess up your house, your landlord sounds mean, I would watch out if I was you. you should see about finding a lawyer about man or lady who ever is your landlord.
