Can i sue my previous landlord for this?
My previous landlord is trying to sue me for damages to the house and not paying rent when they kicked us out 3 months before the lease is up. Also they kept the security deposit that I was promised i would get back. Can i counter sue them for the months that were left on the contract and counter sue for the harassment he gave me over the damages that i have picture proof that there was not any. You can only counter sue for actual damages. Not harassment, not rent you did not pay anyway.

You can sue for the deposit though. You need to prove you did not break the lease, did not owe any rent, cleaned the unit before you left and did not damage anything.

He will be there proving damage and non-payment.

You can counter-sue for anything as long as you can prove

1. What the person did. (and prove that it was them who did it)
2. How that person's actions violate the law
3. How the illegal actions hurt you directly
4. How the harm caused by the illegal actions justifies the amount you are asking for in your lawsuit.

If you can prove that your landlord was in the wrong for kicking you out early and withholding your security deposit, then the only thing that's left to do is justify the dollar value of your lawsuit by show the extent to which the landlord's illegal actions caused you harm.

My guess is that you don't have a case. The landlord likely had a valid legal reason to kick you out early because landlords typically don't kick people out if they are paying their rent and taking good care of the property.

If your landlord has filed suit against you; you first need to get all your documentation in a row to provide for your adequate defense against the landlords complaint, once in court if you wish to counter claim then bring it up your issues, just ensure you are legally entitled under state statute what you seek from the courts

Courts have ruled that landlords have to prove damages (with receipts and such) in order to keep tenants deposits. The counter-suing part I don't know about. If you have photos then you might talk with an attorney. Find one that doesn't charge for the intital meeting. Sounds like you might have a good case.

Landlords must mitigate their damages. In order words, they have to re-rent the apartment as soon as possible. Since you did not break the lease, you, IMO, are not responsible for the remaining balance due.

Read your lease regarding the security deposit. Most Landlord-Tenant laws prevent a security deposit from being used as rent and some states require a deposit to be placed in an interest bearing account.

If your ex-LL is claiming damage as the reason for keeping the security deposit, file a small claims suit for the deposit and ask the judge to order the LL to provide the receipts for the repairs and photos of the damage.

Also ask the LL to prove the difference between the move-in and move-out condition of the apartment.

What state did this occur in?

Researching your states "Landlord Tenant laws" will answer a lot of your questions. I ran in to a situation with an old landlord and did my homework. from this I was able to present my finding and quote the laws that they would be violating. In short they backed off!

Absolutely you can countersue them when you answer their petition.
You can sue for security, cost of moving, additional rental costs if new place is more expensive, etc. Harrassment is more difficult, but you can deny claims of damages if you have proof.

In order for the landlord to evict you he/she would have to go to court. They just can't say "get out." Presuming it's a legal eviction and if the cost to repair the damages exceeded the amount of the security deposit, he can and should take you to court. When you moved in did you and the landlord sign a condition report? This should have been a rather detailed report regarding the unit conditions; walls, floor coverings, appliances, windows, etc. Without that it will be a "he said, she said" court battle. Google landlord tenant laws in your state.
