I know that people do it all the time but if i use security deposit as last month rent can landlord still come after me or sue me for last month rent, even tho she hasn't lost anything out of it, $500 last mth $500 security ? I mean she doesn't maintain property took 1 full year to get a working fridge and the oven is broke again took her months to fix first time now going on 3 mths 2nd time around, bugs, holes in ceiling, furnace was never inspected in 3 yrs we lived there, what should i do, moving in like 2 wks sooo please inform me Additional Details it's not all of a sudden unlivable it's things ahe's never taken care of, i never signed a lease NEVER it has always been a month to month, landlord has never repaired anything except when i told her i wasn't giving her rent unless we get a fridge, which is legal to do. |

In some states, the law imposes a requirement on landlords to keep the security deposit in a separate account from their own money--this makes sense because, legally speaking, the money does not belong to the landlord. A security deposit belongs to the tenant until it is later refunded or applied to cover unpaid rent or damage beyond normal wear and tear.
I don't know what state you live in but in NJ... You have a right to use the security deposit as rent.The law also says that if the landlord does not put the security money in a proper bank account, or does not give a proper written notice to the tenant every time the law says he or she has to, then the tenant can give a written notice to the landlord telling the landlord to use the whole deposit (plus seven percent interest per year) to pay the tenant’s rent. (But be sure to read the next paragraph, which talks about a special situation.)
This notice should be sent to the landlord by certified mail, return receipt requested, and you should keep a copy. The money can be used to pay future rent or any back rent the tenant owes. Once a tenant legally tells the landlord to use the security deposit as rent, the landlord can’t ask the tenant for another deposit as long as the tenant lives in the apartment or house. |

when you leave a place the landlord will use the security deposit towards any unpaid rent, util bills, etc. however if you caused more than normal wear and tear she may sue you to recover any amount over the security deposit. Keep in mind if you don't pay your last months rent she can serve you a 3 day pay or quit meaning if you dont pay the rent within 3 days she need to be completely out of the place if your not she can legally evict you. |

You are not supposed to use the security as rent. If you decide to, you could be on the hook for late fees and set up a possible case of possible " damage " to the apartment just to get back at you.
Your best idea is to talk to the landlord and tell her about all the problems you are having and make sure, in writing, that you are not to blame and it will not come out of the security. Find out what you need to do to get back the deposit. She may just be OK with you using it as rent since it is the 15th, or not. |

Wrong!!!! Yes it is legal to withhold rent in some states...but not unless you follow proper legal procedures. Only a judge can determine if rent should be withheld. |

Technically a security deposit is for damages and repairs only not for last months rent. If she has to use your deposit as last months rent then she can come after you for damages to the house so either way you're going to end up owing money.
If you are moving in two weeks then I'm assuming you haven't paid rent for September. Pay her the money and make sure the place is in good condition when you move out. Make sure you've documented all the problems wrong so she doesn't come back and try to get you to repair items also photograph the place upon move out so you have proof that you left it in good condition. Bugs are your problem not the landlords, if you have bugs after you moved in then it's due to leaving food out and dirty dishes etc. If you moved in and there were roaches then yes, your landlord is responsible for pest control, however, you could easily have picked something up at your local Home Improvement store and sprayed yourself.
Regardless of whether or not you signed a lease is irrelevant you are still a tenant-at-will in the eyes of the law and no, you cannot use your security deposit as last months rent unless you discussed it with your landlord at the time you gave her notice to move out and she would have to agree to use it as last months rent. If you didn't then legally you owe last months rent. |
