Can landlord enter my apartment at will. i live in florida and I refuse to pay anymore rent, im not on a lease
im not on a written lease or anything just verbal, when i moved in me and my landlord had a verbal agreement on rental terms such as direct tv (cable t.v.) and all electric is included in the rent well i got a call from my landlord sayin that he cant afford the cable anymore and i had to get it in my own name and pay for it myself. therefore im refusing to pay anymore rent, and he calls me all day, but my main questions are do i have any rights since we on on no sort of written lease, and i work from home can the landlord shut off the power? or walk in to the dweeling while im working or sleeping? and if he does have to give me notice to come in do i have to say its ok for him to come in b/c like i said i work from home and i cant have him comming in and distracting me. WHAT ARE MY OVERALL RIGHTS???? he doesnt even know my name or ssn or anything, i never signed anything.
im gonna just let him evict me but i need to know my rights

It sounds like you have no right to be there at all. He can call the police and have you arrested as a trespasser.

Cable is not something a landlord is required to do. It does not give you the right to withold rent. Seems he has been up to this point a good landlord.

If you were worried about your rights, you might have gotten your agreement in writing. He does have to give notice before entering and cannot bully you with phone calls. But if you do not pay rent, he can evict you and I doubt that you will find any sympathy for your case from a judge.

i used to be a land lord for thirty years.. he called you and said i cant affort to pay the cable tv .. you should have said how much less will my rent be.. if it was fifty a month for the cable and he cut it off.. i would have said will you cut my rent by fifty so i can pay for the cable myself.... and the landlord cannot enter the property when you are sleeping or taking a shower... but with no payment of rent he can change the locks also he can give you thirty days notice to leave.. i would think of wether it benifited you or do you like staying there.. if i moved what would the neighborhood be like would i be safe..all the landlord wants is the rent money thats it and a person not to damage the place.. i suggest talking to the man about the cable tv and anything else.. just be friendly and humble and you will be ok.. please just try it .. you will be satisfied in the end.

DirecTV and Electricity aren't all that much. Why would anybody be willing to be evicted over that?

I don't know the Rental Laws in Floriday, but I'm pretty sure your Landlord can't enter the premises at will. He CAN ruin your credit and make life more difficult for you to get another apartment, purchase a car and down the road maybe buy a house.

If you didn't get your lease agreement in writing, then you don't really have much legal standing.

Since you have a verbal lease, it is basically month to month and he can change the terms simply by giving a 30 day notice. So even though he said the rent includes cable and utilities, he could change this and the rent amount by giving you proper notice. He does not have the right to shut off the power, but again he could change the verbal lease and require that you start paying for the utilities.

Just because he now refuses to pay for cable, does not give you the right to not pay rent at all. I know that a lot of tenants think that just because a landlord doesn't do something like make a necessary repair, that gives them the right to withhold rent. It does not.

Entry into your apartment by the landlord should require that he give you at least 24 hours notice unless it is and emergency.

You also have the right to give him a 30 days notice that you are moving.

Why don't you find a more constructive way of handling this, like maybe deducting the cost of basic off your rent. A reduction in services equals a reduction in rent pretty much everywhere. You are shooting yourself in the foot by going to the extreme of not paying rent. He can sue you for the money and he doesn't need a lease to prove that you owe him.

He can't shut the power off. That falls under the illegal lock-out umbrella. But what he can do is evict you for non-payment.

I'm sure he knows your name. You get mail. He can read.

He needs to give you notice of entry unless there is an emergency.

You have a contract. It is a verbal contract. The day you paid him rent sealed that contract. You may not have it in writing but it is a legal contract.
Now since you do not have the cable in writing you are out of luck on that one. However if it was to be part of the rental agreement then he is giving you a notice of the increase of the cable rental. That is his legal right. Now as far as you not paying rent. You have left yourself open to an eviction and can be put on your credit report. And it will effect you getting any other rental later. Now as far as him calling you every day he is in his rights to collect a debt that you owe him.
Now for the entering part. He MUST give you a 24 hr. notice to enter. But he better have a reason to enter.
Now he is my advice. Pay his rent today! Look for another place to rent starting today. Find a new place and give your 30 day notice in writing and keep a copy. Then you could try to sue him but without that rental in writing it would be real hard.
Best of luck and do yourself a favor and pay that rent.

If you are not paying rent, your rights go out the windows. You may not have signed a contract, but you are considered a tenant and can be evicted and sued. It will be fairly easy for your landlord to get all your information using a Private Investigator. So, then he can sue you and garnish your wages.

Also, with an eviction on your record, you'll have a hard time finding a rental in the future(except for trashy apartments with bad management).

I would suggest that you check into a Landlord Tenant Act that may be in place for the State of Florida. That way you would have the right information to go to your landlord with.

Since you are on a verbal contract, there is nothing you can prove about the claim on your side, and he can always say he put you up "for a while" to help you out.

Generally, a landlord can only enter your suite/room if he notifies you sifficiently in advance either verbally or in writing, or in an emergency, i.e.: water/gas leak, etc., without prior notification.

Now, if you're holding a rent strike, make sure that you place the rent into a seperate account so that if you are ruled against, you can pay-out as needed.

In any case...consult a Property Lawyer in Florida.

Oooh, verbal contracts can be rather risky. I don't know that you have a whole heck of a lot of legal rights without a bunch of court battles that probably won't go your way. Who's to say you even really have a right to be there if nothing's officially in your name? He could try to say you were just a squatter and so he kicked you out when he realized you were in his personal extra get-away apartment. I think not paying the rent would probably forfeit any rights that you would have had, even with a written contract.

I've had standard, written rent contracts where I think the agreement was that they'd at least leave a note saying why they were there and what they did. They didn't have to tell me they were coming, I don't think, unless it was something out of the ordinary -- although I probably could have requested that if it bothered me. They *always* needed a good reason to be there, and it would be the middle of the day or early afternoon. It was never a problem. They called me when I was getting ready to move out to let me know that they were wanting to show the place in a week or two so I could pick up around the place if I wanted to, and (knowing me) I probably just waived my right to know exactly when ahead of time because I really didn't care.

You can make verbal agreements all you want, but it comes down to he-said he-said. Not to sound harsh, but you took a huge risk in moving in without anything legally signed and binding, and it backfired. He can shut off the power if he chooses, etc. Unfortunately, your rights are limited because nothing has been signed.

I'd pack up and move out and go somewhere where you do have to sign a lease. If you don't, then you have limited rights.

FYI this guy sounds kinda creepy and shady, and if he can't afford the cable, I'd keep your valuables on you at all times uuntil you do leave.

A landlord is only supposed to enter a rental unit with the tenant's permission or if he/she suspects there is some type of emergency. Example: he/she smells gas and needs to see if there is a leak. So, you are refusing to pay rent because the lanlord won't pay for cable? There aren't a lot of units where the cable and electric are included. I would say, Yes, the landlord can have the power shut off since he's the one paying for it. It sounds like your landlord needs some lessons in renting property if he let you move in and doesn't even know your name.
