Can landlord give day notice?
Ive been residing here in my apartment for 5years and the owner call me last month to tell me he sold the property and I should move I agreed. Today I received a letter of one day eviction. is this possible

When he first talked to you about selling the property did he give you a date to be out by? That could count as a verbal 30 days notice. If that date came and passed - the 1 day notice could be legal.

If he never gave you any date to be out and just mentioned the sale in passing then he still has to give you 30 days notice.

You don't say what state your in - I would check with a real estate attorney in your state to be sure.

Core
1 day is short, but in my area they're only required to give a 2 day notice so you never know. You'll have to check your state laws to be sure.

If you live in the UK there is no such thing as a one day eviction go to court with your solicitor and see what you can do

No, I don't believe so. If landlord has sold the property it has to go threw escrow which can take anywhere between 10 - 60 days. But usually takes 30 days. He would also file a unlawful detain-er with the courts. Then a court representative (process server or marshal) would have to serve you with eviction papers.

Also, you shouldn't have agreed to move. Just because he sold property doesn't mean the new owner wants tenants to move. The new owners will need money coming in to make mortgage payments.

You also can look into what the laws are for your state. Use your search engine for tenant rights or landlord tenants rights.

Good luck.

If you have a written lease the new owner must honor it. If you are on a month to month the landlord must give you at least 30 days notice and in some states longer if you have lived there for over a year.

Depends. If the eviction letter was from the court or sheriff...they yes it's possible. If the letter was from the owner...then no, he needs to give you a 30 day notice to vacate.

An actual eviction requires a 30 days formal notice - and that's after the landlord has gone through very specific steps to file for eviction and everything else.

You'll have to check with your state's laws on renting, but I'm pretty sure he needs to give you much more than just 1 day's notice. The phone call does not count as formal notice.

Gertie
No they have to give you at least a 30 day notice.
