Can landlord prove that damage was not there when I moved in even if they don't have before pics?
My landlord is suing for damages that she claims we caused. The dishwasher leaked through the floor. It was leaking when we moved in. We only used it 4 or 5 times. There is no way we could have cause the "$4000" worth of damage she is accusing us of. She took pics about 5 weeks after we moved in. We moved out at week 6. It just so happened that a guy she had to do an estimate was my husband's best friend. He says that was an old water stain. He offered to fix it for $100. She had called and said she was having her daughter pick up some of her stuff in our attic. She came when we weren't there. It turns out that she did an inspection. She wasn't supposed to do that until a certain date. My landlord called another day and said she needed to pick up some stuff. She came in with a camera and started taking pictures and unhooked our dishwasher. Very rude lady. Because there was a few clothes on the couch she said the place was a mess.

She now claims that we burned a hole in a deck floor. I haven't even seen that damage. We haven't had any type of fire there. There was fire damage to the porch roof caused by a grill they used before we moved in. The interior wood floors were very scratched up before we moved in. All this stuff she pointed out before we moved in. There were no pics though. She is adding to the court costs : Her gas bill from driving from Florida and re-rental ad...even though she told the judge she didn't feel safe renting again. Kinda like a pity story. All the stuff she is accusing us of us FALSE. She has pics but not before pics. How can this case go??

No your not reposnible for items that belong to her. She owns it so she needs to fix it. Plus when you rent you pay for the house while you live there that inspection was illgeal she invaded your space. Its not her opinion to judge you. Take her to court you have a good case against her.

He cant prove it was there, But can you prove it wasnt? Whats your rent history like with him because thats gonna be a major roll in the decision of the court. Who was the most dependable you or him?

When you first moved in did you and your landlord walk through with a list of repairs that were needed? Did you walk through yourself and make a list? You don't necessarily have to have pictures to prove a point in court. I would take all the correspondence, names numbers, dates and times so that the the judge can see you documented everything as well. Right now it sounds a bit one sided and you will have to prove your side. The judge will make his decision based on who he believes more the tenant or the landlord.

Get a lawyer is absolutely without a doubt the right thing to do. However, since I've only had experience living in an apartment, this will cause me to start taking pictures when I move in and religiously going through the check-in sheet and returning it. We had a $99 deposit. There is nothing in our lease that says they can charge us for damages beyond the $99. I was thinking this is not an issue for us since we have not caused any damages here but maybe I need to think further because it seems that the landlord is trying to sue you for damages there are not your fault.

It' would be good to know how this turns out but I know this is not the forum for that.

A lawyer might be a wise back-up, but without pictures taken BEFORE or actually WHEN you moved in, she has no proof these were not "pre-existing conditions" and so she has no case.

You might just want go to court. She probably expects to intimidate you into "paying up" by bringing the suit. Ask the judge if there is any merit in her comments about the place being a mess (there isn't, SHE didn't live there, you did!), ask if she had a warrant or permission to enter the property (she can't do that without "compelling reason")

If the dishwasher came with the apartment, it was HER responsibility to fix it, not yours!

Be polite. Be honest. Then countersue her for "trying to bring your reputation as a tenant into disrepute".

I have some issues with my apartments and it really seems that the tenants get screwed. You have such little control over your own items it's ridiculous. I wouldn't think she could get away with that but I would prepare my self to pay just in case. I wouldn't worry about the clothes and what she says because my house is generally clean but if you come on a day where I am behind on everything my house is a disaster and that happens. I hope everything works out ok and seeing as you only lived there breifly I wouldn't think anyone would believe you did all that damage.
I was reading some comments and I wanted to tell you that
I talked to a lawyer if the people in my apartment can come in and mess with my washer and dryer when I spcifically told them not to. I found out they can pretty much do what they want when they want reguardless of what I say.

If it was leaking when you moved in it should be on the move in inspection sheet signed by both you and your landlord. If you didn't do one of those, it will be your word against hers.

If she's claiming $4,000 worth of damages there is probably a lot less than that in actual repairs and it might cost her more in lawyer fees than it is worth...

Check out your local small claim court rules and your local landlord/tenant laws, you'll probably find your answer there. By the way, the fact that the place is a mess is her concern ONLY if it creates a negative situation for the property. For example, if you leave a pile of dirty dishes in the sink for weeks on end and it attracts roaches or mice, than she has a right to be concerned.

Of course, if this goes to court, the fact that you moved out after only 6 weeks will not be a point in your favor. Unless of course you had a 6-week lease.

the burden of proof is on them. most landlords give tenants checklists to id damages before moving in, if they do not then its harder for them to prove anything, landlords are responsible for covering their *** bc tenants rights really come into effect recently. like one poster said, hold your ground and dont let this sleezeball intimidate you. a few years ago my landlord took me to court for eviction bc i refused to pay rent for a winter month in which i didnt have heat and they made little effort to fix, on top of that the furnace, i came to discover was an altered coal unit and is very illegal. needless to say i got out of some rent after holding my ground, doing some research, and covering my butt. edit: also dont bring up the fact that your dad passed, if it goes to court, im sorry for your loss but its irrelevant..in court.

So... she provided you with a leaky dishwasher and now she wants to sue you because the dishwasher she gave you leaked? Sounds like she's on pretty shaky ground there even if the damage occured while you lived there. (Especially if you told her it was leaky when you found out it leaks!)

If you guys did a walkthrough and signed something that said there was no damage, she could try to use that as evidence that the damage wasn't there, I guess.

I bet she loses this one.

If I were you, I wouldn't speak to anyone until you have legal advice. Document everything said to you, or that you say to them. Keep good notes. AND GET A LAWYER, now. Good Luck!

Tell her to get stuffed. If you have only been there six weeks how could the water damage have rotted anything. Go see a lawyer.

You should have taken pictures yourself to document the damage yourself, a judge would be able to tell it was pre existing, you should always do a walk through with a camera before moving any of your stuff in.

Has the dishwasher been there when you moved in? Then it is the landlords fault for having a faulty appliance.
If it was his machine then it is his property that caused the damage.
Have it examined for the duration the damage has been caused. Is the damage long time caused? If so then the landlord has no case. Get legal advice now!
If you look a little naive then he might be taking advantage of you. Courts are used to dodgy landlords but build up a case now and take pictures of the damage and get it independently assessed.
